Readers of The Tribune have
learned to look forward to each new
and successful achievment of Rome’s
great daily. We have issued several
special editions since the present
management has been in charge and
we are happy to say that each and
every one has been an improvement
on its predecessor as has been evinced
by the popular public favor with
which they have been received.
Early in November we intend to issue
a special edition which will eclipse
our previous efforts. Rome is steadily
growing and there is healthy and sub
stantial improvement going on all
over the section of country tributary
to the North Georgia metropolis. Now
is the time to keep our advantages
before the people.
In no Other way can this be done
quite so successfully as through the
medium of a widely circulated news
paper like The Tribune. Every edi
tion of a special character that we
have gotten out has gone abroad on
its mission of progress and the results
have been made apparent by the at
tention attracted to this section of
country.
We have endeavored to make every
edition as full and complete as possi
ble, but in this one we want to cover
the whole ground. All that we ask is
the liberal co-operation of the people
for whom we have labored so earnestly
and for whom we expect to continue
to work as long as we control the des
tinies of The Tribune
It will be to the interest of every
business or professional man in North
Georgia and North and East Alabama,
to secure space in this great issue
The merchant, the manufacturer, the
land owner, the mine operator, the
professional man and all who are in
terested in educational, industrial
work, or emigration work, will be
benefitted by represention in its col
umns.
Not less than ten thousand readers,
in every part of the country, and
especially in the West and North west,
will read this great edition and profit
by the information gained from its'
columns. Our solicitors are already
out and will make a thorough canvass
of the country contiguous to Rome
and we bespeak for them the consider
ation which they are entitled to in
promoting this laudable enterprise in
the interest of our city and section.
Death of CoJ. C. I. Grave*
As we go to press we learn of the
death of Col. C. I. Graves, an old con
federate soldier. He was agent here
fer a number of years of the E. T., V.
& G. railroad. The funeral' notice
will appear in tomorrow’s Tribune.

a.Lumpkin, J.—As will appear from
an inspection of the official report,
the bill of exceptions in this case is so
defective and incomplete that it pre
sents no question with which this
court can intelligently deal.
Judgment affirmed.

Stewart, Unholter& Co. v. Sholl et
al. Before Judge Milner. Whitfield
superior court.
Atkinson, J.—l. It is the duty of the
clerk of the superior court, whether
specially so requested or not, to enter
upon the attachment docket which
the act of December 20,1890(acts 1890-
91, vol. 1, p. 208,) requires him to keep
attachments filed in his office; and if
be fail to enter an attachment so filed
within the time fixed by law, and his
failure to do so in any particular in
stance results in injury to the plaintiff
in attachment, the clerk and his sure-

2. A judgment rendered in a supe
rior court of this state in an action
founded upon a judgment rendered in
another state, is not void because ren
dered by the judge without the inter
vention of a jury, it not appearing
that any plea presenting an issue of
fact triable by a jury had been filed
by the defendant,

Simmons, C. J.—l. There being suf
ficient evidence to support a finding
that the injury complained of was
caused by the defendant’s negligence,
there was no error in overruling the cer
tiorari, which presented for review by
the superior court the single question
whether or not the verdict in the
magistrate’s court was contrary to law
and the evidence.
2. The alleged error in admitting evi
dence could not be considered by the
superior court, for the reason that the
petition for certiorari did not state what,
if any, objection was made when the
evidence in question was offered.

Strickland v. Vance. Before Judge Mil
ner. Gordon superior court.
Lumpkin J. —l. One who takes a
promissory note payable to himself,
signed by a man and his wife, appar
ently as joint principals, is in law
chargeable with a knowledge of the real
consideration o'the paper and of the
wife’s true relation thereto, whether he
conducted in person, or by another, the
negotiations leading to its exeention and
delivery to himself: and if, in fact, the
wife signed the note as surety for her
husband, it was void as to her, and she
could maintain against the payee an
action for the recovery of money or
property belonging to her separate estate
with which she had parted in settlement
of the note.
2. No material error of law was com
mitted on the trial, and the evidence war
ranted the verdict.

McCutchen & Shumate, contra.
Prat et al. v. Finkell. Before Judge Mil
ner. Whitfield superior court.
Lumpkin, J.—The evidence warranted
a finding for the plaintiff; but inasmuch
as the verdict exceeded the amount sued
for the excess must be written off, and
the costs of this writ of error be borne by
the defendant in error.
Judgement affirmed, with direc - ion.

Cureton v. Clop ton. Before Judge Mil
ner. Dade superior court.
Atkinson, J.—The evidence, though
decidedly conflicting, warranted the ver
dict. Some of the alleged newly discov
ered evidence was evidently within the
knowledge of the defendant at the time
of the trial, and all of it might have been
obtained before that time by the .exercises
of proper diligence. As a whole it would
not probably change the result.
