A Pleasant Call.
Dr. J. P. Bowdoin, editor of the
Adairsville Banner, paid the Tribune
a pleasant call yesterday. He says tbe
wheat fields are green in the vale of
Oothcaloga.

The Alex Order.
The “Alex” order had a very suc
cessful meeting last Friday night. A
new member was admitted and other
business was transacted. The ‘Alex”
order is one of Rome’s best clubs, and
is composed of some very excellent
“Smart Alecks.”
A New Life Saver.
Dr. Frank Wynn has a curiosity in the
shape of the split bullet which dropped
out of Will Mason’s wound. The wire
suspender buckle caused it to split into
three pieces and diverted its course, sav
ing the young man’s life, in ah proba
bility.

dule now in effect on the Southern Rail
way and it is beyond all peradventure
the Lest one they ever ran so far as Rome

PROBALE PROMOTION.
Father M. J. Clifford May be Made
Bishop.
In the next election of Bishop Becker,
of the Catholic diocese of Georgia,‘to the
position of president of the American
University at Washington. Father M. J.
Clifford may be raised to the bishopric.
Three names, these of Father Couaty,
of Massaschusetts, Bishop Becker, of
Georgia, and one from New York, have
been forwarded to the pope.
Os these Bishop Becker stands a very
good chance for the ptesidency of the
University.
In case of his eleetion Father Clifford
stands in the direct line of promotion to
the bishopric.
In his work in the Rome parish, having
charge of sixteen churches, he has shown

Big Times the Boys are Having in

Mr. Charles W. Underwood has re
turned from Atlanta where he at
tended the meeting of the Knights of
Pythis Press association.
The boys are having big times in
Atlanta.
The programme yesterday was as
follows:
9 A. M.—Business session of the As
sociation at the Kimball House.
2 30 P. M.— Trolley Ride.
5 P. M.—Lunch at the Fulton Club.
8 P. M.—Exemplification of the
Knights Rank at the Columbia
Theatre, by the Rank Team of At
lanta Lodge No. 20.
Today the program will include the
exemplification of the rank of knight
by a select assemblage of knights.
The full program for today is as fol
lows:
10 A. M.—Visit to the state eapitol
and the legislature in session
3 P. M.— Business session of the as
sociation.
BP. M.—Lunch tendered the Na
tional Pythian Press Association, by

Judge Lumpkins’ Decision Will Rev
olutionize Loans
I? MAY MEAN A GREAT DEAL
The Loan Computes Will Probably Have
To Slop Thur Usurious
Agencies.
The following decision handed down
by Judge Lumpkin, of the supreme
bench of Georgia, will probably have
the effect to place a great deal of liti
gation in the courts in the immediate
future. The language on its face and
its construction will have a tendency
to revolutionize the matter of loans
between loan companies and borrow
ers who have paid legal rates of in
terest and fees to an agent for its ne
gotiation. Here it is:
Pottle vs. Lowe et al. Before Judge
Hart. Jones superior court.
Lumpkin, J.—l. A loan of money
made in consideration of the maxi
mum legal rate of interest and one
half of the commissions charged by a
third person for negotiating the loan,
is usurious; and, under such circum
stances, it is immaterial whether the
third person is the agent of the lender
or of the borrower, or of both.
2. A deed executed by a borrower
under section 1969 et seq. of the code,
to secure a debt infected with usury,
and purporting not only to convey
title to the lender, but also to confer
upon the latter a power of sale, is ab
solutely void, and therefore ineffect
ual either to pass title or to create a
valid power of sale.
3. The grantee in such a degd can
not, either as holder of the legal title
or as his attorney in fact, make a
valid conveyance, even to an inno
cent purchaser without notice of the
usury.
4. Under the facts disclosed by the
record the verdict for the plaintiffs
was manifestly contrary to law.
Judgement reversed.

A number of Rome’s leading
lawyers were interviewed on the
subject and so grave is the import
and so farreaching is the probable re
sult that they would not give any ex
pressions for publication. The appa
rent effect will be to cause writs of
ejectment to be issued in case origin
al borrowers desire to plead usury.
Jt will in all probability cause much
trouble throughout Georgia, as thou*
sands of farms have been sold under
deeds covered by this decision, which
deeds are no more and no less
than mortgages. It may also have the
effect to go into every county in the
Union, as these loan companies have
agents everywhere. To illustrate:
If A wants one thousand dollars from
the loan company he goes to B, their
agent. B. says yes I can get you the
money at 8 per cent interest, but for
the trouble of negotiating the matter
I charge you 10 per cent, or one bun
dred dollars. A, the borrower, pays
B the 10 per cent and gets nine hun
dred dollars and gives a deed for oue
thousand dollars at 8 per cent inter
est.and through strokesof misfortune
bad management etc., he can’t pay back
the Loan company sells his property to
an innocent purchaser and the
innocent purchaser to another and so or.
Now under the above decision A., or the
original borrower, can plead usury and
get back his property. At any rate this
is the appearance of the decision.
The outcome will be watched with
much interest. There have been, prob
able, from twenty to fifty such sales
made here in Floyd county and
thousands throughout tbe state and tens
of thousands all over the Union. It may
now, unless a revtew is taken by the
Georgia supreme court, go to the United
States supreme court for finedecisibn.
