it is enforced by the courts and when
it is enforced outside? Certainly any
trial or conviction or sentence which
disregards the forms of justice is es
sentially lynch law.
If you mean to ask whether or not
the counsel for Flanagan will shape
bis conduct by regard for public sen
timent, on one hand, or by
regard for his duty to his client and to
the law, on the other, you are an
swered that he will certainly follow
the latter, though every man, woman
and child in the state were opposed to
him.
I believe this man to be insane and
to have been proven so to a demon
stration by every sort of evidence up
on which that conclusion could be es
tablished. As to whether or not lam
correct, the proper forum to decide it
is the court, and I decline to submit to
an adjudication by public sentiment.
I know that the time will never come
in Georgia when a member of its bar
will submit his convictions as to his
duty and the rights of his client to
any tribunal except the legal one.
So answering your question, I beg
to say to you that counsel for Flana
gan will heed nothing except what he

nized and aphorized adjudicators of
the law of this state.
Don't you think you had better clear
away the blood from your eyes and look
at this matter in a more calm and dis
passionate spirit, and when you do so,
•don’t you think you are likely to discover
that such talk as yout editorial will do no
good either in appeasing the mob spirit,
or in upholding the law?
You had just as well do this, because
you can be assured that everything which
I can do to protect, not simply this man
from "being hanged, but the State from
the eternal stigma and disgrace of having
immolated an irresponsible creature in
order to appease a thirst for blood, will
be done; and if the expression of such
views as you entertain should provoke
this man’s lynching, the responsibility
shall rest where it really belongs, upon
you and others who inculcate like doc

neau, says: "There are 500 people now
at Dyea waging to get over the pass
and there are several more steamer
loads on the way. The Indian packers
and the pack animals have ail the
freight they can carry to the lakes by
the time winter sets in and hundreds of
people will be camping at Dyea and on
the lakes all winter eating the provi
sions they have taken with them. Prices
for packing across the pass have risen
to 25 and 27 cents per pound and the
packers are independent at that.”

true is evidenced by the high respect
and fear in which the British law is
held, and the further fact that mob law
is practically unknown where British
courts have jurisdiction.
The British system takes into con
sideration that the agreement between
members of society called law is not a
onesided agreement favoring violators
of the compact. Our system throws
every safeguard around the accused,
Every technicality may be taken ad
vantage of by the criminal, bnt none
may be used against him. The com
monwealth is at a disadvantage at al
most every stage of the proceedings,
through the overpowering d,esire and
purpose of our forbears to conserve per
sonal liberty.
Even after the state has secured a
conviction, against odds, it is by no
means certain that the judgment of tbe
court will be carried out. Skilled at
torneys have learned to thread the
labyrinth of the law so expertly that a
conviction is by no means conclusive.
Even after the gamut of the courts has
been run, with adverse conclusions in
each, it is still a question if the convict
will suffer the penalty imposed by the
law and the courts. Convicting jurors
have frequently been known to ask in a
body that. executive clemency be ex
tended to the convict, and it is notor
iously a fact that nothing is easier than
to get up a petition for pardon. Inter
ested attorneys, the family of tbe con
vict and persons of sickly sentimental
ity circulate petitions, and people of in
fluence unthinkingly or carelessly sign
them. The papers go to the good
hearted governor, and he, ‘‘tempering
justice with mercy,” releases the con
vict to prey once more upon society.
A striking example of the futility of
attempting to “temper justice with
mercy” in some cases occurred in our
own state only a short time ago. A
notorious swindler serving time in
the penitentiary was, upon petition,
granted a full pardon. In a few weeks
he was once more “a high roller in
society,” and within a few months
had become a fugitive from justice,
after having victimized a number
of people to the extent of thousands

What is needed in this country is >
a revision of the laws and of court ’
procedure as will give the people at
least an equal opportunity with the
prisoner in matters of justice and
mercy.

Topeka, Aug. 4. The federal au
thorities aud the state of Kansas will
prebably clash. Last Week Federal
Judge Williams, from Arkansas, held
qourt al Manitou, Colo., and issued a
sweeping injunction on behalf of the
Mutual Life Insurance company of New
York, restraining Insurance Superin
tendent McCall from enforcing the state
laws regulating insurance companies,
and also enjoining Attorney General
Byer or any other lawyer, on behalf of
the state, from bringing any civil or
criminal suit against the company. It
is this order that Governor Leedy and
the state administration propose to
contest

Augusta, Ga., Aug. 4.—Florian Bind
wald, secretary of the Augusta Brew
ing company, was drowned at Murray
Hill, u suburb of Augusta. He was in
bathing in the lake and went beyond
his depth, not knowing how to swim.
Mr. Bindwald came to Augusta from
Louisville, Ky. He was well known
throughout Georgia and South Carolina.

Indian Cattle Thieves.
Phenix, A. T., Aug. 4.—Gordon
Huusacker, one of the wealthiest pio
neer ranchers of the Sult riyer valley, is
being held a prisoner by the Mexican
authorities at El Piomo. in the state of
Sonora. About a month or more ago
Huusacker left Mesa City for toe south
ern part of tie territory to find and iden
tify some cattle thieves.

large herd of cattie from Indians. These
cattle proved to have been stolen and

the officers was wounded. Hunsacker
has been arrested and is held as a wit
ness against the Indians and the Mexi
