DECISION IN TANGLED LAW CASE
Several Railroads and the State ot Georgia
Mixed Up in It—Will Be Appealed
to Supreme < ourt.
Special Chancellor 11. A. Chambers
has rendered his decision in the long liti
gated cause as to the ownership of the
Union depot property, which has been
hanging tire in the chancery court since
1890 says the Chattanooga Times.
Judge Chambers holds that the Nashs
ville. Chattanooga and St. Louis railway
and the Western and Atlantic railway,
are owners of the soil on which ,the de
pot is located, and the building, improve'
meats, etc., are the property of the two
corporations named and the East Tennes
see, Virginia and Georgia railway and
the Memphis and Charleston. The com
plainants in the suit, the East Tennessee,
Virginia and Georgia road, averred that
they were a part owner in the soil, but
the court holds otherwise. This suit is
one of the most interesting cases that has
been before a Hamilton county court in
years, and contains many tangled law
points.
The suit was begun by the East Ten
nessee, Virginia and Georgia railway
for the purpose of forcing a sale for
partition of the Union depot property.
The original bill was short and made
the Nashville and Chattanooga road
and the state of Georgia, as the sole
owner of the Western and Atlantic, and
the Memphis and Charleston as owners.
It charged that the copaplainant was
also an owner in a fourth undividtd
interest in the entire property, and that
the remaining interests were in the de
fendants , % the Western and Atlantic or
Georgia owning one-half interest They
alleged that a partition of the kind was
possible, and asked a sale.
This proceeding was commenced July
31, 1891, by the original bill of the East
Tennessee, Virginia and Georgia com
pany against the Nashville and Chatta
nooga, the state of Geogia and the Mem
phis and Charleston as joint defendants.
The Memphis and Charleston filed a
cross bill, claiming a one-fourth owner
ship in ihe property, and asked that it
be so declared’ and it that coulcf not be
done it wanted alien for the amount of
money advanced in improving the lot—
that is, the erection of the depot, in
which the four parties to the suit were
jointly interested under an old agree
ment The lot in oontrov.-rsy is coverei
by the depot and car shed.
The next step taken was the filing of
an amended bill by the complainants,
in which an elaborate history of the
case was given, from which it appears
that the state of Georgia acquired a
right of way in Tennessee from the
Georgia line to the Tennessee river at
Chattanooga by virtue of an act of the
legislature, passed in 1838; that in 1857
and 1858 certain agreements were made
between the Western and Atlantic and
the Nashville, Chattanooga and St.
Louis for the erection of a passenger
station on the lot in controversy. Under
this the old passenger shed was erected
and improvements and repairs thereaf
ter made. In 1875 Georgia filed
a bill in chancery court against
the other railroads, the Nashville
and Chattanooga, East Tennessee and the
Memphis and Charleston, to cause them
to pay their proportionate part of certain
expenses made in regard to the passenger
shed, in which finally an agreed decree
was entered, showing the amount each of
the parties were to pay. In 1881 it was
determined to make extensions and im
provements between the car shed and
Ninth street, and also at the south end of
the car shed, which constitute the present
building on the lot. The purpose of
this suit, as stated in the introduction,
was to have a sale for partition of .this
property between the East Tennessee and
the other parties who had assisted in
making the improvements. The com
plainant bases its claim upen various
agreements entered into in 1857-8 and the
conduct of the parties afterwards, ai d

it a tenant in common in the lot covered
by the improvements as well as in the

improvements themselves, and that the
character of the prope-ty was such that a
partition in kind could not be had, and
that it was necessary as well as to the in
terests of the parties that it be sold and
the proceeds' divided- The amended
bill was a long and elaborate one, but
winds up with the prayer for the sale of
the property for a division of proceeds,
or if that could not be done by virtue of
the partition laws of this state, that then
the parties be declared partners and the
paitnership be wound up.
The case will be appealed to the su
preme court at once, none of the parties
to the suit being satisfied with Judge
Chambers’ decision.

San Francisco. Aug. 20. —Attorney
Lewis Titus of this city has just begun
his third collegiate year at the Univer
sity of California as a studeut by proxy.
For one y< r Titus was a regular stu
deut at Bai-ely, attending the univer
sity in person. Then he passed the ex
aminations tor admission to the bar and
his business kept him on this side of
the bay.
His wife took up his work at the be
ginning of the sophomore year and is
now his proxy in the class rooms, ill
the evenings' she goes over the work
with her husband, who has thus far
taken every examination with credit
and will graduate at the end of the year.

Financial Report <>f Christian Endeiivor.
San FhanCisco, Aug. 20.—The finan
' cial report of the Christian Endeavor ’97
I committee wiil. be officially presented to
the quarterly convention of the Golden
Gate union on Sept. 8. It will show
over $25,000 was collected, but the ex
penses exceeded this amount by about
$1,200. The deficiency will be made up
from the proceeds of the two big con
certs. With the proceeds of these two
concerts there will remain a small sur
plus, which' is to be used for Endeavor
work.

Kewntd Been Doubled.
Cheyenne. Wy.. Aug. 20.—United
States Marshal McDermott has been
advised by the attorney general to dou
ble the amount of the reward offered by
the department of justice for the cap
ture of stage robbers in the National
park. Five hundred dollars will now
lie paid for rhe arrest and conviction of
the holdups.

which Douglas Jerrold was present, and

Devonshire House and never saw any

Thought She Would Make Tom Happy,
but Both Are Now Miserable.
Daughters of wealthy men who fall
in love with their fathers’ employees
are not entirely restricted to uo v ele.
There is a Chicago merchant whose con
fidential man has for some time been a
•suitor for his daughter’s hand. There
is another departure from tradition in
the fact that his love affair is not as
violently opposed as it might be. He is
a thoroughly, capable and upright fel
low, and his prospective father-in-law
probably doesn’t see why he wouldn’t
do just as well as a clubman or per
haps a nobleman for his daughter’s hus
band. Os course the two lovers like to
be as much as possible in each other’s
company and try all sorts of little
schemes and inventions to bring this
happy state of affairs about.
The other 'evening when the young
man, whose familiar name is Tom,
called at the hopie of his fiancee she
was perfectly radiant.
“Oh, Tom, I have just the best piece
of news to tell you!” she said to him.
“Indeed!” was his reply. “Tell it to
me right away.”
“I know you will be so glad I did
it,” she continued.
“Did what?”'
“I’m going to tell yon all about it.
Papa said this morning that he was go
ing to California, to be gone a month.
He said I’d enjoy the scenery and the
climate, and he thought there wasn’t
any trip that I’d like so much. Oh, he
wanted me to go awfully bad, but I
just thought that I wouldn’t see you for
a month, and so I took a stand. I must
have made 50 excuses. Finally I told
him that I’d promised to go to Cousin
Maude’s at Lake Geneva, and that I
just couldn’t break my promise, so at
last he let me off. It was hard work,
and I’m almost afraid I made him
angry, but I knew you’d be so glad.”
“Yes—um—of course,” responded
Tom.
“Well, you don’t look half es glad
as I thought you would.”
“No—l” he began.
“Then you’re not glad,” she said in
a tone of mixed surprise and disappoint
ment.
“Well, no, darling,” he said. “You

CANNED GOODS.
The Most Flagrant and Extensive ILinds
of Adulteration Are Practiced.
Under one heading we may consider
several groups' of food stuffs, which,
while different in composition, are alike
in. the form of adulteration which is re
sorted to These groups include the va
rieties of canned vegetables, fruit but
| ters, jellies, preserves and catchups. The
forms of adulterations common to all
of these consist in the use of coloring
matter, of imperfect vegetables or
fruits, of other fruits and vegetables
than those called for or of preservatives.
In the case of canned vegetables there is
an accidental adulteration from the in
gredients of the can, such as lead and
tin, and which may, as a rule, be’at
tributed to a lack of care in canning.
In all of the groups mentioned the
adulteration practiced is of the most
flagrant and extensive kind. Catchups
are made of skins and cores instead of
the pure vegetables, then colored with
a coal tar product and loaded with sali
cylic acid to prevent fermentation.
Fruit butters are nothing but parings
and scrapings of fruit to which glucose,
starch and coloring have been added,
with salicylic acid as a preservative.
Jellies are made from glucose flavored
with essential oils and colored, to which
salicylic acid is added. Some fruit jel
lies marked as pure have never seen a
trace of fruit. What is true of jellies is
true of preserves. Put together refuse
material, the cheapest sort* of glucose,
some coloring and salicylic acid, and
you have the composition of some of the
cheaper forms of preserves that are to
■ be found on the shelves of some of our
grocery steres. Os these coarser forms
of adulterations it will bo unnecessary
to say even a word. They nre universal
ly recognized as unfit to be used, and
every honest dealer is cf the opinion
that the sooner they are driven out of
the market thq better it will be for
