The sale of the dea lly cigarette will
begin in Tennessee today after being un
der the ban of the law for a brief period,
says the Chattanooga Times. Judge
Lurtoa yesterday at Nashville rendered a
decision that makes the law pas-ed by
the last legislature absolutely nugatory.
The story is told in the following press
dispatch from Nashville:
Nashville, Tenn., Sept. 30.. In the
proceedings brough before
United States Circuit Judge Lurton by
W. 8. Sawrte, arrested under the state
anti cigarette law charged with violating
its provision?, Judge Lurton today hand,
ed down his decision holding that the
anti-cigarette law is uncot stitutional in
that it conflicts with the commercnl
clause of the constitution of the United
Ssates, and holding the action of the
st ite court to be illegal and ordering the
• patitiouer to be set at liberty.
The meat of the whole opinion of ap
proximately five thousand words, is cov
ered in the concluding paragraphs,
to-wit:
“But this Tennessee statute, in so far
as it prevents importation and sales in
original packages by importers, is not a
quarantine or inspection statute, and is
not based upon the statute or condition
of cigarettes. The Tennessee statute is
too broad and is repugnant to commer
cial clause of the constitution of the
1 United States in so far as it. inhibits im
portation of cigarettes from foreign na
tions or other states or their sale by im
porter in the form in which they were
imported..
“I reach this con clusion without any
hesitation, though . reluctant to strike
down a statute aimed at the suppression
of an evil of most pronounced character.”

THE BREADFRUIT TREE.
Something: About This Strange and Useful
Asiatic Plant.
The breadfruit tree is a native of
southern Asia, the south Pacific islands
and the Indian archipelago. In appear
ance it resembles somewhat the wild
chestnut. It grows to the height of 40
or 50 feet and has dark green leaves,
many of them two feet in length, which
fcre deeply divided into pointed lobes.
Hidden among the great leaves the
breadfruit grows. It is a sorosis, is
nearly spherical, often weighs four or
more pounds and has a thick, yellow
rind. This fruit is the chief food of the
south sea islanders. They seldom eat a
meal without it. The eatable part lies
between the rind and the core and
When fully ripe is yellow and juicy. It
is better for food before it has matured,
and the natives gather it while the
pulp is white.
Before it is ready for table use it must

bread, and is both palatable and uutri
tibis. Usually the fruitjs cut into three
or four slices and roasted or in
an oven.
| Frequently the people of a village
' join in making a huge oven, in which
several hundred breadfruits may be
baked at one time. Thus they are all
supplied with bread without its cost
ing any of them much labor. Prepared
|in this way, the bread will keep for
weeks.
The breadfruit is in season eight
months of the year. When the season
finally draws to a close, the last fruits
are gathered and made into a sour paste
called “mahei. ” This paste will keep
good for months and is made into balls,
wrapped in leaves and baked, just as
needed.
Bread is not the only product of the
breadfruit tree. From it cement, cloth,
tinder and lumber are also obtained. A
glutinous, milky juice oozes from the
trunk of the tree, which makes an ex
cellent cement when boiled with cocoa
nut oil. From the fibrous inner bark a
kind of coarse cloth is made, and the
big leaves make good towels. The lum
ber is used for building houses and
many other purposes. Betides all this
the dried blossoms are used as tinder
when fires are kindled.—Philadelphia

REPORT ON' FAIR ESTATE.

says that the appraisers of the late
James G. fair’s estate have completed
their task and will present their record
to the probate court in a few days. The
report will show that the value of the
Fair estate has been very much over
rated. Instead of being valued at from
$80,000.000 to $60,000,000, the appraisers
tay the official figures will be about
$12,000,000, and certainly not more than
$15,000,000. These figures have been
reached after continuous and careful
work by the appraise: s.
F or a fortune is invested for the most
part in real estate, the greater part of
which is in this city, but the principal
item of the estate consists of $4,000,000
in bonds of the Southern Pacific U,,ast
railway, built by Fair aud now a part
of the Southern Pacific system. The
valuation of the Fair estate is signifi
cant in view of the testimony given by
' Fair in a trial several years ago in Yolo
county, when, in reply to a question,
he said he was worth at least $30,000,-
000. It is evident that in the lust few
years of his life Fair sustained serious
losses, the facts concerning which are
carefully concealed.

Consul General Miguel Carrillo of this
city, and Consul General Dr. Joaquin
Yela of New York, who arrived on the
San Blas, reports of war in Guatemala
have been greatly exaggerated. Consul
Carillo says:
“The revolution in our country is con
fined entirely to San Marcos, Quezalte
nan go, and the port of Oct os. Port
Octos is a shipping place for coffee
crops, and has a population of about 200
people. The other places may have
i>,ooo inhabitants, but-that is doubtful.”

"I am more than surprised at the in
terest taken by Americans in this little
uprising. I can state officially that the
whole thing is overdrawn. The riot is

Valdosta. Ga.. Oct. I. Shelton Dam
pier, the Slayer of Sum Parker, at Ha
hira, three weeks ago, was captured by
a sheriff’s posse in a little log house on
the Barfield place, 4 miles from Hahira.
The murderer held the officers at bay
for six hours aud only surrendered after
being wounded in tiie right shoulder
aud seeing that further resistance was
useie.-s. Several hundred shots were
exchanged, but not one of the posse was
Wounded. ''
The killing'of Parker was itself, a
thrilling stpry. Three years ago Mr.
Parker had occasion to prosecute Dam
pier. aud succeeded in having him sen
tenced to the penitentiary for three
years
"When my time is up," said he
threateningly to Mr. Parker, as he wat
led away from being sentenced, "I will
square up with you. So use the time

It was on a Sunday morning in Ha
hira, after church hud been dismissed,
when Mr. Parker was standing with a
group of friends in conversation, that a
strange man walked up.
“My time lias come, ” said he, as he
pulled down on Mr. Parker, aud began
sending load after load into his body.
It was Dampier, who. had returned
from the penitentiary to wreak revenge.
As he saw his victim fall dead, he re
treated, keeping the onlookers under
the muzzle of his revolver until he had
got out of reach.- Then entering the
pine forests be disappeared, until lo
cated by the sheriff’s posse, aud his
arrest followed.

Fatal of a Physician.
Huntsville. Ala.. Oct. While the
residence of J. W. Echols, at Gurley,
Ala., was burning, Dr. J. C. Fiynt fell
into a well 20 feet deep ami was proba
bly fnraliy injured, Toe top of the well
had buined and Dr. F-ynt fell through,
carrying a mass of flames down with
him. Tiie woodwork that went down
broke bis fail, but as there was no water
in the well the fire was not extinguished
and he, was badly ffurned.
