By virtue of the power of sale
contained in that certain Deed to
Secure Debt from Eddie D. Toole
to Vidalia Federal Savings Bank,
dated September 27, 2017, filed
on October 5, 2017, and recorded
in Deed Book 1197, pages 206-
209, in the Office of the Clerk of
the Superior Court of Toombs
County, Georgia, which secured
a promissory note from Eddie D.
Toole to Vidalia Federal Savings
Bank in the original principal
amount of $167,000.00, there will
be sold at public outcry for cash
to the highest bidder before the
courthouse doors of said county
between the legal hours of sale
on July 6, 2021, the first Tuesday
of July, 2021, by Vidalia Federal
Savings Bank, as attorney-in-fact
for Eddie D. Toole, the following
described property, to-wit:
All that certain tract or parcel of
land, situate, lying and being in
the 43rd G.M. District of Toombs
County, Georgia, containing

pany and Lands of John P. Toole;
East by lands of Mrs. H.V. Smith;
on the South by a county road;
and on the west by a county

state Route 56 to Gray’s Landing.
Said property being more particu
larly described by a plat of survey
made by Leland H. Moss, Sur
veyor, dated January 26, 1972,
and designated on said plat as
Lamar Toole, 36.272 acres, said
plat being recorded in Toombs
County Plat Book 3, page 193
and by reference made a part and
parcel of this deed and descrip
tion.
LESS AND EXCEPT: A 5.19 acre
tract located in the Northeast cor
ner of the above property which
was conveyed to H.J. Fowler by
Warranty Deed dated August 30,
1974, and recorded on Toombs
County Deed Book 133, page
208; and said tract being more
particularly described by a plat of
survey by C.G. Alexander, Sur
veyor, dated August 27, 1974 and
recorded in Toombs County Plat
Book 10, page 357.
Subject to any rights to any well
or water system agreement which
is owned by Grantor to this prop
erty. If the within property is fore
closed upon, Grantor grants the
Grantee their successors and/or
assigns the rights to use water
from the water system at the rate
of the water system for residential
uses at that time.
Also subject to any existing water
line or water line easements as
they may exist on the above de
scribed property.
As a covenant running with the
land, Grantor places the following
restrictions on the land as a cov
enant running with the land and
binding on Grantees, their suc
cessors and assigns. Grantee
shall not place a hog pen, a
chicken house or a junk yard on
the property.
The indebtedness secured by
said Deed to Secure Debt having
been declared due and payable
because of default in the payment
of the indebtedness secured,
thereby this sale will be made for
the purpose of paying the same
and all expenses of the sale, in
cluding attorney’s fees, notice of
intention to collect attorney’s fees
having been given as provided by
law.
A copy of this legal advertise
ment (Notice of Sale Under
Power) which was sent to the
Advance has been mailed by cer
tified mail, return receipt re
quested to Eddie D. Toole, as re
quired by Georgia law, O.C.G.A.
§44-14-162.2.
The property will be sold as the
property of Eddie D. Toole, sub
ject to the following: (1) all prior
restrictive covenants, easements,
right-of-ways, or encumbrances;
(2) all valid zoning ordinances; (3)
matters which would be disclosed
by an accurate survey of the
property; and (4) all outstanding
taxes, assessments, unpaid bills,
charges, and expenses that con
stitute liens against the property,
whether due and payable or not
yet due and payable.
Vidalia Federal Savings Bank is
the holder of the Note and Deed
to Secure Debt to the property in
accordance with O.C.G.A. §44-
14-162.2. The person that has full
authority to negotiate, amend,
and modify all terms of the mort
gage with the debtors and his
address is as follows: Hal
Chesser, and he may be reached
at the Vidalia Federal Savings
Bank office, 300 Jackson Street,
Vidalia, GA 30474, or by tele
phone at (912) 537-8805. The
foregoing notwithstanding, noth
ing in O.C.G.A. 44-14-162.2 shall
be construed to require Vidalia
Federal Savings Bank to negoti
ate, amend, or modify the terms
of the Deed to Secure Debt de
scribed herein.
