By virtue of the power of sale
contained in that certain Deed to
Secure Debt from Shanetta
Lenelle Simmons to George I.
Powell, dated April 21,2020, filed
on April 22, 2020, and recorded
in Deed Book 1298, pages 38-
40, in the Office of the Clerk of
the Superior Court of Toombs
County, Georgia, which secured
a promissory note from Shanetta
Lenelle Simmons to George I.
Powell, in the original principal
amount of $44,000.00, there will
be sold at public outcry for cash
to the highest bidder before the
courthouse doors of said county
between the legal hours of sale
on November 1, 2022, the first
Tuesday of November, 2022, by
George I. Powell, as attorney-in-
fact for Shanetta Lenelle Sim
mons, the following described
property, to-wit:
All that tract or parcel of land situ
ate, lying and being in the City of
Vidalia, 51st G.M. District of
Toombs County, Georgia, known
as Lot No. 10 in Block A, Mead-
owbrook Heights Revised Exten
sion, and being more particularly
shown on a certain plat of survey
prepared by John E. Dykes, Reg
istered Surveyor, dated July 6,
1972, and recorded in Plat Book
8, page 376, in the Office of the
Clerk of the Superior Court of
Toombs County, Georgia, which
plat and record thereof are incor
porated herein, by reference, and
made a part of this description.
Said tract is bounded, now or
formerly, as follows: North by
land of Obelisk Properties, LLC;
East by land of City of Vidalia,
South by land of Dwight R. Rich
ardson; and West by the right-of-
way of Mike Street. Said tract is
the same tract as conveyed to
George I. Powell from J. David
Lovins, by warranty deed, re
corded on October 8, 1986, in
Deed Book 218, page 236, in the
Office of the Clerk of the Supe
rior Court of Toombs County,
Georgia.
Subject to all easements, restric
tions, and right-of-ways of re
cord.
The indebtedness secured by
said Deed to Secure Debt having
been declared due and payable
because of default in the pay
ment of the indebtedness se
cured, thereby this sale will be
made for the purpose of paying
the same and all expenses of the
sale, including attorney’s fees,
notice of intention to collect at
torney’s fees having been given
as provided by law.
A copy of this legal advertise
ment (Notice of Sale Under
Power) which was sent to the
Advance has been mailed by
certified mail, return receipt re
quested to Shanetta Lenelle
Simmons, as required by Geor
gia law, O.C.G.A. §44-14-162.2.
The property will be sold as the
property of Shelby Lenelle Sim
mons, subject to the following:
(1) all prior restrictive covenants,
easements, right-of-ways, or en
cumbrances; (2) all valid zoning
ordinances; (3) matters which
would be disclosed by an accu
rate survey of the property; and
(4) all outstanding taxes, assess
ments, unpaid bills, charges, and
expenses that constitute liens
against the property, whether
due and payable or not yet due
and payable.
George I. Powell is the holder of
the Note and Deed to Secure
Debt to the property in accor
dance with O.C.G.A. §44-14-
162.2. The person that has full
authority to negotiate, amend,
and modify all terms of the mort
gage with the debtors and his
address is as follows: George I.
Powell, and he may be reached
at 883 S. Thompson Road, Vida
lia, GA 30474, or by telephone at
(912) 293-2289. The foregoing
notwithstanding, nothing in
O.C.G.A. 44-14-162.2 shall be
construed to require George I.
Powell to negotiate, amend, or
modify the terms of the Deed to
Secure Debt described herein.
The undersigned reserves the
right to reject any and all bids, to
continue the sale from day to
day, and to withdraw said prop
erty from sale and subsequently
to reoffer same in the event no
reasonable bid is received and
accepted.
To the best of the under
signed’s knowledge and belief,
the party in possession is Sha
netta Lenelle Simmons, tenants,
or parties claiming under the
aforementioned.
The sale will be conducted
subject to (1) to confirmation that
the sale is not prohibited under
the U.S. Bankruptcy Code, and
(2) to final confirmation and audit
of the status of the loan with the
holder of the security deed, in
cluding but not limited to a deter
mination that the loan was not
reinstated prior to the foreclo
sure.
