AUBURN POLICE
Auburn PD makes three arrests
Three people were arrested by the Auburn Police Department
last week and taken to Barrow County and Gwinnett County
jails. Listed below are their names, ages, addresses and the
charges for their arrests. An arrest occurs when an officer has
probable cause to believe that a crime has been committed or if
a person commits a crime in an officer's presence. An arrest is
not a conviction of guilt.
The following names were provided by a jail media report
distributed by the Barrow County Sheriff's Office:
•Nicholas Shawn Williams, 31, of 91 Williams St., Winder;
four counts felony probation violation.
•Patricia Ann Dimiceli, 46, of 316 Carter Road 84, Auburn;
giving false name.
•Zachary Lee Smith, 19, of 1641 Saddlecreek Court, Auburn;
obstruction/hindering law enforcement (misdemeanor).

Suwanee man really wants
another man’s liquid assets
A 43-year-old Suwannee man was arrested after he knocked
on the residence of his 18-year-old friend’s girlfriend's mother’s
house on Thurmond Road armed with a pistol. According to a
report, the man was looking for the 18-year-old because he had
not heard from him in almost two days. The homeowner told a
deputy that the 18-year-old had been inside the residence since
his car broke down two days prior. She reportedly told him he
could stay at her residence because he felt uncomfortable stay
ing at the Suwannee man’s home. Apparently, the Suwannee
man is a drug user and was upset with the 18-year-old because
he refused to urinate for him so he would pass a drug test.
Woman’s adult son won’t
be disrespected in her home
A Briarwood Road woman called police on her adult son
after he reportedly became very boisterous and cursed at her
when she asked him to clean the bathroom near his room. The
woman told a sheriff's deputy that she told her 23-year-old son
he could pack his things and move out. According to an inci
dent report, the man became even more upset after his mother
told him to leave and got “nose to nose" with her while accus
ing her of “going on a power trip” and “getting in his business
unnecessarily.” The woman said she called police when her son
told her that if she were a man he would knock her out and con
tinued to become even angrier. While talking with the deputy,
the woman’s son said that his mother “acts like she's his boss”
and that “he won’t let anybody talk to him and disrespect him
in that way.” The man was arrested when he told the deputy he
would hit his mother if she was a man and said, “If she was a
[N-word], I would have done punched her face in!” He was
arrested for simple assault family violence and taken to jail.
Father and son arrested following
bizarre incident with dog
A 45-year-old man and his 18-year-old son were both arrested
at their Dogwood Trail residence after they got in a fight over
the family dog defecating on the floor. According to an incident
report, the son woke up to his father yelling at his mother. The
father then retrieved a rifle out of a closet and said he planned
to shoot the dog. The altercation became physical in the kitchen
and the mother tried to intervene. Then the father locked the
son out of the house. The son then began hitting the side of the
house with a shovel and busted a screen on one of the windows
of the house. The father came out of the house and chased the
son down the street with a rake and then reportedly called the
sheriff's office. A deputy wrote in the report that the mother
reportedly had bruises on her arm from trying to intervene in
the physical fight between her husband and son. A juvenile
child was also at the residence reportedly hiding underneath a
bed because he was scared. The father was arrested for battery
on his wife and simple battery on his son. The son was arrested
for criminal trespass for busting the screen on the window with
the shovel. Both men were taken to jail.
Man gets citation for
spouting off in his lawn
A sheriff’s deputy responded to a loud music complaint on
Hidden Acres Road at a residence about 50 feet off the road.
He saw a white man come out of the house as he pulled into
the driveway. Then he saw another white male with no shirt on
drinking a beer come outside the residence. The deputy asked
the men if they would not mind turning the music down or shut
ting the door. One man said yes, while the other asked what the
deputy was doing on their property. When the deputy told the
man he was responding to a noise complaint, the man began
yelling obscenities about injustice and became confrontational
in front of his neighbors and children. The deputy issued the
man a county ordinance citation.
Strange man told to stay away
from neighbors house
A man called the sheriff's office to report that his 18-year-old
daughter called him from their Smith Cemetery Road residence
to complain about a strange neighbor. The daughter said their
37-year-old male neighbor began walking around in their yard
and then knocked on the door. When she answered the door,
the man reportedly told her that he was looking for his dog.
The teen informed him that she had not seen the dog and as she
attempted to close the door, the man began asking her questions
about her father. She said every time she attempted to close the
door, the man would continue to talk to her. She said he told
her that she was a pretty girl and asked her how old she was.
She said she began to feel uncomfortable because she was the
only one home so she closed the door and locked it. The teen’s
father called him again 20 minutes later to report that she got
into her vehicle to leave and noticed a piece of paper on the
floorboard from a magazine and there was a picture of a naked
woman. A deputy responded to the neighbor's house and met
with the man's mother. The deputy told her that her son was
not welcome at the neighboring residence. The woman told the
deputy that she would make sure he knew that he did not need
to go back onto the property.
STATHAM POLICE
Man uses expletive to identify female neighbor
A Statham police officer respond
ed to a report of disorderly conduct
on Butterfly Lane. A woman said she
overheard one of her neighbor’s call
her a “bitch” while showing a worker
his property. According to an incident
report, the woman said the neighbor
reportedly said, “You see that stump
right there? That's where that ‘bitch'
had my tree cut down.” The woman's
husband then confronted the neighbor
about the statement, to which the neigh
bor reportedly replied, “I don’t know,
but I will call her a dope head.” Both
the woman and her husband reported
the incident the same way. An officer
then spoke to the neighbor. The man
admitted he did in fact call the woman
a “bitch” and a “dope head,” however
he declined to give a written statement.
The officer then spoke to an exterior
project specialist who the neighbor has
supposedly hired to construct a privacy
fence between the two yards who was
a witness to the incident. He said he
heard the statement. The officer told the
neighbor that a privacy fence would be
a good idea.
OTHER INCIDENTS
In other incidents, Statham police
reported:
•speeding on Atlanta Highway.
An officer on patrol clocked a 1999
Mitsubishi Galant traveling 50 miles
per hour in a 35 mile per hour zone.
The driver did not have a valid driver's
license. He was arrested and taken to
the Barrow County jail and issued cita
tions for speeding and driving while
unlicensed.
•agency assist on Ga. Hwy. 316. An
officer responded to Ga. Hwy. 316 near
Wall Road to assist a Barrow County
Sheriff’s Deputy who made a traffic
stop on a wrong way driver. The driver
of a Volkswagon was a 41-year-old
female. When asked if she had con
sumed any alcohol that day, the woman
replied “no.” Asked if she was taking
any medications, the woman said she
had filled a bottle of medication pre
scribed for sleeping on that day. As the
officer was talking with the woman, he
noticed an alcoholic beverage in the
passenger’s side door. He touched it
and it was still cold. He then asked the
woman if she had consumed any and
she admitted to drinking what was gone
from the can, which was approximately
half, according to an incident report.
The woman consented to field sobriety
evaluations.
•theft by taking more than $500 on
Bethlehem Road. An officer responded
to the U.S. Army Reserve Training
Center under construction to report the
overnight taking of 30 cast iron cou
plings and four 90-degree couplings, a
value of $964. There were no suspects
at the time of the report.
The Statham Police Department
issued 23 citations and five warnings
last week bringing the total number of
citations for the year to 632 with 104
warnings total.

The following people also are or were
being held at the BCDC. Listed below
are their names, ages, addresses and the
charges for their arrests by the Statham
Police Department.

•Cecilio Flores-Juarez, 36, of 461 Epps
Bridge Court, Athens; misdemeanor driv
ing without a valid license, speeding in
excess of maximum limits.
•Charity Lee Franklin, 24, of 950
Jefferson River Road, Jefferson; posses
sion of schedule II narcotic, prescription
drugs must be kept in their original con
tainers, criminal trespass.
•Lamont Howard, 49, homeless; crimi
nal trespass, probation violation, giving
false name, address or birthdate to a police
officer, possession of a schedule IV con
trolled substance, prescription drugs must
be kept in their original containers.
•Jeremy Hunter Shaw, 21, of 835
Harrison Mill Road, Bethlehem; speeding
in excess of maximum limits, seat belt vio
lation, possession of less than one ounce
of marijuana.
HEALTH INSPECTIONS
Recent Barrow County health inspections scores given
Health inspectors look for “criti
cal” and “non-critical” violations dur
ing inspections of food establishments.
Critical violations can result in food
related disease. Non-critical violations
do not result in any points off, but must
be corrected by the next regular inspec
tion.
A food establishment is considered
high risk if one or more critical viola
tions (9 points each) are found. Low
risk means no critical violations were
found and the establishment scored a 90
or above.
Health Department recent restaurant
inspections for Barrow County estab
lishments are as follows:
•A&J Red Dragon Inc., 133 West
Athens St. Suite A, Winder, 83 (B) -
two critical violations: proper cold hold
ing temperatures. Garlic in oil and eggs
out at room temperature at grill. Proper
cold holding temperatures: multiple
foods at buffet less than 135 degrees
Fahrenheit. Non-critical violations: no
Servsafe certification posted. Inspection
report behind counter. Rice scoop stored
in water at room temperature. Plates at
serving line not inverted to protect food
contact surface. Single service items
stored under fish tank. Restaurant has
non-NSF Freezer.
•Paddy's at Chateau Elan, 1 Elan
Court, Braselton, 100 (A) - no critical
violations.
•The Inn at Chateau Elan, 100 Rue
Charlemagne, Braselton, 82 (B) - one
critical violation: no bare hand contact
with ready-to-eat foods. An employee
was seen handling a black cheese without
gloves. Non-critical violations: multiple
foods in walk in, reach in and freezer not
stored, covered. Dish machine not heat
sanitizing to 180 degrees. Foods being
cooled in thick, deep plastic covers, not
on top shelf, loosely covered. Leak at
condenser in walk in freezer. Handles
of oven greasy and sticky with food
accumulation. Food debris in shelving
on floor in dry storage.
•Arby's No. 5223, 46 East May St.,
Winder, 94 (A) - no critical viola
tions. Non critical-violations: employee
drink cup observed in kitchen without
lid. Outside garbage dumpster observed
without lid. Ceiling tiles observed with
water damage in dining area. Light fix
ture in kitchen not shielded.

yellow rice cooker as well as sesame
seed bulk.
