AUBURN POLICE
Man charged with simple battery against officer
An Auburn police officer was sent to
the hospital last week after an irate man
who had already been Tased kicked him
repeatedly in the leg and private area
while resisting arrest.
Johnny Ray Smith, 42, was charged with
obstructing or hindering law enforcement
officers, terroristic threats and acts and
simple battery against a police officer.
According to an Auburn Police
Department incident report, officers were
responding to a domestic dispute report
at Smith’s Mount Moriah Road address,
when they found the allegedly intoxicat
ed and beligerant man yelling obscenities
while in a fight with his son.
Smith was Tased after officers tried to
get him to sit down outside his residence
and talk, but he refused. While a med unit
checked the man out, he reportedly yelled
at his son that he was going to kill him.
Officers attempted to escort Smith to the
back of a patrol car in order to take him to
jail, but he attempted several times to pull
away in order to get to his son.
The injured officer was taken to Barrow
Regional Medical Center and was diag
nosed with a sprained knee and contu
sions. Smith was taken to the Barrow
County jail.
AUBURN ARRESTS
Auburn Police officers arrested the fol
lowing people last week. Listed below
are their charges with the APD:
•James Floyd Brannon, 25, of 297
Dandelion Lane, Auburn; reckless driv
ing, failure to maintain lane, following
too closely, DUI-drugs 1st offense.
•Stephen Kyle Disney, 25, of 126
Ashwood Drive, Winder; speeding in
excess of maximum limits, driving while
license suspended or revoked 1st offense
in five years;
•Roque Lugo Fortunato, 30, of 1739
Killian Hill Road, Lilbum; failure to
maintain lane, driving without a license-
failure to obtain in 30 days;
•Dillon Vallee Hunt, 21, of 151 Huff
Drive, Lawrenceville; warning device
violation, failure to obey stop sign, DUI-
alcohol, possession and use of drug
related objects, entering automobile with
intent to commit theft or felony, felony
theft by receiving stolen property;
AUBURN INCIDENTS
In other incidents. Auburn police
responded to reports of:
•theft by taking misdemeanor at
Subway on Atlanta Highway. A store
manager called police after discovering
via security camera video that one of his
employees had allegedly stolen $20 out
of the cash register over the weekend.
Officers watched the video and saw the
34-year-old female employee take money
from the register. The manager contacted
the owner who said that he did not want
to press charges if the woman returned
the cash. When she showed up for work,
she was confronted by the manager and
returned the $20. She was subsequently
fired.
•traffic violation/complaint on Hilltop
Circle. A 25-year-old man was arrested
after officers witnessed a Ford Mustang
tailgating a truck when it passed their
patrol vehicles and crossing over the
double yellow lines. The driver of the
truck was reportedly also pointing at
the driver of the Mustang. As the driver
of the Mustang tried to pass the truck,
an officer tried to initiate a traffic stop,
but the Mustang allegedly sped off. The
officer caught up with the suspect at a
Hilltop Circle address, where he was
detained for officer safety, according to
the incident report. The driver reportedly
was unsteady on his feet and had trouble
understanding any instruction. He also
said he was sorry and that he was just
driving aggressively because his new
car was so powerful. After being granted
consent to search the vehicle and perform
field sobriety tests, officers found no ille
gal drugs or weapons, but did suspect the
man to be under the influence. He was
taken to the Gwinnett County jail.
•domestic dispute on Carter Road. An
anonymous complainant alerted police to
a fight between two brothers. The fight
reportedly ensued after a female witness
and her sister decided to leave the resi
dence and one of the brother's called her
a derogatory name.
•accidental structure fire on Mount
Moriah Road. Auburn officers assisted
with traffic direction Oct. 31 at 393 Mt.
Moriah Rd. According to an incident
report, it was determined that the hom
eowner’s adult daughter had been outside
smoking on the front porch prior to the
fire being discovered in a potted plant.
There were three female occupants at the
residence during the incident.
•traffic violation/complaint on County
Line Auburn Road. A 30-year-old man
was arrested when an officer on patrol
pulled over a green Honda Civic after it
had crossed over the yellow centerline
twice. The driver provided a Washington
state driver’s license and the driver did
return out of Georgia, but was unlicensed.
When asked if he was a legal citizen of
the United States, the driver reportedly
never gave an answer. He was arrested
and taken to the Gwinnett County jail.
•traffic violation/complaint on Mount
Moriah Road. A 25-year-old man was
arrested after an officer on patrol was
conducting stationary vehicle checks at
County Line Auburn and Carter roads.
The suspect reportedly approached the
intersection in a Geo Tracker traveling 54
mph in a 35 mph zone. The man told the
officer that he was late for a class that he
attends at the methadone clinic in Auburn
and he did not realize that he was speed
ing. When asked for his license, the man
provided an expired limited permit. He
was arrested on scene and taken to the
Gwinnett County jail.
•disorderly conduct on Main Street.
Two men were cited for disturbing the
peace after officers responding to a
domestic dispute reportedly asked for
and received permission to enter the resi
dence where the incident occurred.
BRASELTON POLICE
Woman: Sister’s lying causing her criminal problems
A Braselton woman told police that
she believes that her sister has given
police officers in Athens her name
when the sister was stopped on a traf
fic violation, according to an incident
report.
The sister had given the Braselton
woman’s name and date of birth on
more than one occasion in Athens and
the woman believed that she recently
did it again.
The woman, who lives on Reisling
Drive, had been arrested in 2005 for
the activity and believed that the mat
ter had been resolved, but she recently
received a notice in the mail that her
driver’s license would be suspended if
she didn’t take care of another traffic
citation.
The woman gave a Braselton officer
copies of her work schedule show
ing that she was at work when the
most recent traffic stop was made. The
woman couldn’t provide an address for
her sister, but said she had been arrest
ed on unrelated charges a few months
ago in Athens.
BRASELTON INCIDENTS
The Braselton Police Department
responded to the following incidents
last week:
•agency assist at a Ga. Hwy. 211
address, where a man was sitting at a
table at a business with blood on his
arms. The man told an officer that he
intentionally cut both of his arms with
a box cutter at a relative’s house before
walking to the business. An ambulance
took the man to a hospital.
•criminal trespass warning at a
Mossy Oak Landing address, where
a woman said another woman was
harassing her by continually contact
ing her. The second woman was in the
first woman’s driveway at the time. The
second woman said she wanted to get
her soap back from the first woman,
but she later changed her mind and
didn’t want the soap anymore. The sec
ond woman refused to sign a criminal
trespass warning when an officer gave
it to her.
BRASELTON ARRESTS
The Braselton Police Department
made the following arrests last week:
•Jamie Christopher Pines, 24, 928
Old Thompson Mill Road, Winder,
disorderly under the influence, failure
to meet tail light requirements and
DUI. During a traffic stop, Pines said
he drank several shots in the past hour
at a local bar, according to an incident
report. After an officer said he deter
mined that Pines was unsafe to drive
because of his performance on several
field sobriety tests, Pines was arrested
and placed in a patrol vehicle. Pines
then began slamming his head into a
window of the patrol vehicle and con
tinued to do so as an officer drove him
to jail, according to police. At the jail,
Pines remained uncooperative with the
deputies and was placed in a restraint
chair. An officer said he couldn’t get
a breath sample from Pines at the jail
because he was uncooperative. Several
other passengers who were in Pines’
vehicle were released from the scene,
but couldn’t drive because they were
intoxicated.
•Noel Biondi, 19, 5532 Pleasant
Woods Drive, Flowery Branch, fail
ure to maintain lane, underage pos
session of alcohol, DUI and underage
DUI. During a traffic stop, an officer
said the driver of a car, Biondi, had
the smell of moderate alcohol on her.
The officer said he determined that
she was unsafe to drive, after several
field sobriety tests. A passenger in her
vehicle, Rebecca Brooke Cassidy, was
passed out, but later woke and told
the officer she had consumed alcohol.
Both women were under 21 and both
gave breath samples to detect alco
hol. Cassidy also denied that a small
bag of prescription pills found in the
driver’s coat belonged to her. The coat
belonged to Cassidy and the bag was
next to her ID, according to an incident
report. Both women were arrested and
the officer destroyed the pills in front
of his patrol vehicle’s camera as evi
dence.
•Rebecca Brooke Cassidy, 18, 1124
Beaver Dam Road, Hoschton, underage
possession of alcohol.
•Juan A. Ramirez-Morales, 40, 3429
Sentinel Circle, Lawrenceville, driving
while license suspended or revoked.
During a traffic stop to check the
window tint of Ramirez-Morales’ vehi
cle, a background check showed that
his license was suspended. The win
dow tint on the vehicle was fine, but
Ramirez-Morales was taken to jail for
driving on the suspended license.
•Chad Matthew Baker, 41, 19192
Resort Road, Blairs Mills, Pa., failure
to maintain lane, open container of
alcohol while operating a vehicle and
DUI. During a traffic stop, an officer
said Baker had a strong odor of alcohol
on him, and glassy, bloodshot eyes.
Baker said he was at a restaurant and
drank two beers 20 minutes before the
traffic stop, according to an incident
report. An officer found two opened,
partially full beer cans in his vehicle.
An officer determined that Baker was
unsafe to drive after conducting several
field sobriety tests. He also provided
two breath samples to measure alcohol
in his body at the Gwinnett County
Detention Center. Two other people
in Baker’s vehicle were charged with
open container of alcohol in a vehicle
and seat belt violations.
•Charles Daney Parker Jr., 40, 4208
Friendship Road, Buford, possession
of methamphetamine, possession of a
controlled substance and possession or
use of a drug-related object. Parker and
a woman, Angela Dawn Warren, were
causing a disturbance at Wendy’s on
Ga. Hwy. 53. The two had also been
involved in another disturbance call for
police earlier that day. Parker told an
officer he didn’t have any weapons on
him and allowed an officer to search
him. In one of his pockets, an officer
removed a cigarette box that contained
a syringe, 13 suspected hydrocodone
pills, a piece of paper with suspected
meth on it and a bank debit card issued
to another woman, according to an
incident report. Parker said Warren
gave him the cigarette box and he
didn’t know about the pills inside of
it. Parker said he found the debit card
on the street and planned to return it
to its owner. He then admitted that he
knew that the pills were in the box,
but he planned to return those to the
owner, too. He said he put the pills in
the box because Warren was trying to
take them from him. An officer also
found syringes in Warren’s purse that
matched those in the cigarette box
and she was arrested. Both Parker
and Warren were taken to the Jackson
County Jail on charges.
•Angela Dawn Warren, 36, 3041
Centennial Road, Rutledge, posses
sion of meth, possession of a con
trolled substance and possession or
use of drug-related object.
•Lisa E. Baptist, 45, 56 Dorman
Street, New Haven, Conn., driving
while license suspended or revoked,
failure to meet tag light requirements,
possession of less than one ounce of
marijuana and possession of a con
trolled substance. During a traffic
stop, an officer said Baptist appeared
more nervous than the average per
son on a traffic stop. A background
check showed that Baptist’s driver’s
license was suspended. Baptist said
the car belonged to her sister. Baptist
allowed the officer to search the
vehicle, where he found a coat with
a prescription pill bottle in Baptist’s
name and a coin purse with a small
amount of marijuana and crack
cocaine. Baptist claimed that the coat
belonged to her sister. She claimed
the prescription pill bottle, but not
the coin purse. Baptist was placed
under arrest and taken to the Jackson
County Jail.

Place, Winder. A man said that
his two vehicles were broken
into and a GPS unit valued at
$160 was taken.
•discharge of firearm on Bill
Rutledge Road, Winder. A dep
uty responded to a report of
an injured deer approximately
20-yards from the edge of the
roadway. The deer was report
edly put down.
•illegal dumping on Boss
Hardy Road, Auburn. A man
said a black male in a purple van
pulled into his neighbor’s yard
and dumped a bunch of trash
out of the back of the van. The
complainant said he was unsure
if the black male had permis
sion to be on the property so he
called the property owner who
called 911.
•missing person on Mount
Moriah Road, Auburn. The
mother of a missing 30-year-
old mother of two told deputies
that her daughter has not been
seen since Oct. 18 at around
8:30 p.m. A deputy advised the
woman that her daughter would
be placed on a missing person’s
list and as soon as the sheriff’s
office found out her status, she
would be contacted.
•felony burglary on Briscoe
Mill Road, Bethlehem. A prop
erty owner’s neighbor called
police after she noticed a truck
slow down in front of the prop
erty and went to check it out.
She reported that the front door
to the residence on the property
showed signs of forced entry by
possible use of a crowbar, it was
open and a motion sensor light
had been knocked over in the
back yard.
•child custody on Pleasant Hill
Church Road, Winder. A teacher
at Hope Christian Academy said
she received a call from one of
her student’s parents stating that
she did not want anyone to pick
up her daughter from school
except herself. When her hus
band later came to the school
to pick up their daughter, the
teacher called 911. A deputy
came out to resolve the situation
and the child was turned over to
the mother.
•warrant service on East
Wright Street, Winder. A
40-year-old woman was arrest
ed on an outstanding bad check
warrant.
•suspicious incident on
Vinings Court, Winder. A man
asked a deputy if he could finger
print the engine compartment of
his 2004 Buick Rendezvous to
see if his son-in-law had sab
otaged the vehicle because it
no longer worked. The deputy
informed the man that there
were no finger-printable surfac
es in the engine compartment.
The man then asked if the depu
ty could fingerprint the concrete
underneath his vehicle, to which
the deputy also said “no.”
•parole violation on Berkshire
Drive, Winder. A 20-year-old
man was arrested for a parole
violation stemming from an
original charge of burglary.
•battery on Trey Lane, Winder.
A man’s 18-year-old son was
arrested for allegedly punching
his father in the face in a dispute
over a car payment. Apparently,
the son said he was leaving in
the car and not returning if his
father took the privilege of driv
ing it away from him even if
he did not make the payments.
The father then reportedly cut
off a valve stem on one of the
car’s tires, which witnesses said
caused the son to tackle him and
punch him in the face. A deputy
noticed a knot on the right side
of the man’s face.
•suspicious incident on Turk
Road, Bethlehem. A woman
said she received a letter in the
mail saying that she has won
some money so she called the
sheriff’s office to report that she
has never entered into any kind
of sweepstakes.
•criminal trespass on Smith
Drive, Statham. A man called
911 to report that he saw the
driver of a Ford F150 pick
up track pull off the road just
north of his residence, get out
with a rifle and fire a shot. The
unknown suspect was report
edly wearing hunting attire,
orange safety clothing and cam
ouflage.
•request for extra patrol on
Monroe Highway, Bethlehem.
A woman said she was con
cerned her son’s girlfriend was
going to cause a scene at her
residence when she came to
pick up some personal property,
so she wanted to have a deputy
in the area in case she needed
to call for assistance. A deputy
told her a responding deputy
would get there as quickly as
possible if needed, but there
were not enough deputies work
ing to guarantee one would be
really close.
•driving while unlicensed on
Creekwood Road, Winder. A
33-year-old woman was arrest
ed after she asked a deputy on
patrol in his vehicle if he had
noticed a small brown dog run
ning around. When the woman
was asked for her driver’s
license, she provided a Georgia
ID card, confirming she was
unlicensed. A female officer
came to search the woman. She
was arrested for driving while
unlicensed and taken to jail.
•theft by taking motor vehicle
on Sims Road, Winder. A man
reported that after ending a rela
tionship with an ex-girlfriend,
he noticed the gas tank of one of
his vehicles smelled like bleach
and his white/silver 2003 Buick
Rendezvous was missing at a
value of $6,000.
•identity theft on Manning Gin
Road, Monroe. A Lawrenceville
woman came to the sheriff’s
office to report that someone used
her information while obtaining a
citation with the City of Dothan
Police Department because she
received a failure to appear in
court notice in the mail from
the City of Dothan Municipal
Court for running a stop sign.
The woman said it could not be
true because she has never been
to Alabama before. The woman
suspected her sister stole her
identity because she has done it
before.
•warrant service on Piney
Hill Bluff, Winder. A 43-year-
old man was arrested on an out
standing warrant for a proba
tion violation original offense:
obstruction.
