More effectually to provide for the government and protection of the Cherokee Indians, residing within the limits of Georgia, and to preset ibe the bounds of their oceupard claims; and also, to authorise grants to issue for lots drawn in the late Land and Gold Lotteries in certain cases, and to provide for the appointment of an Agent to carry certain parts thereof into execution , and io fix the salary of such Agent ; and tn punish those persons who may deter. Indians from enrolling for emigration. Sec. 1. ZJe it enacted by the Senate and House of Representatives of the State of Georgia, in General Assembly met, and it is hereby enacted bi/ the aut.ority of the saw, That in all cases where a white man is the head of an Indian family, such /iidkin family shall re tain the rights of such property claimed under the rights of such Indian family, the white man ob taining no rights but that of the Indian use and oc- cupation. Sec. 2. ,l/z<Z be it further enacted, That every white man, who may have an Indian family, and who may be desirous of retaining his j nviteges which he may possess as the head of an Indian family, may at any time before the first day | of March next, notify the Clerk of the Superior • Court of the county in which he may reside, in ! writing, of his intention to retain his privileges as i the head of such Indian family : which notification * shall be recorded in a bock to be kept tor that pur- i pose and no other ; and upon the doing of which he shall be entitled to al) the piivileges which are granted to such white man in the pre ceding sec tion of this Act. St.c. 3. .!/.</ be it further enacted, Th it if any Indian or descendant of an Indian, or white man, the head of an Indian family, claim ing tiie privileges of an Indian, shall employ any white man or slave belonging to a while man or person of color other than the descendant of an Indian, as a tenant, croppet or assistant in agricul ture, or as a miller or mill-wright, they shall for such offence, upon the same being estab ished by the testimony of two respectable witnesses, forfeit all right and title, that they may have to any reser vation oi occapancy within the limits ol this state, and th d upon the certificate ol the Agent to be hereafter appointed, grants may issue for ihe styne as though such improvements had never been oc cupied by such Indian descendant of an Indian or white man having an Indian family. ,’■<?/.. 4. Sec. 13. And bt it further cnai ted, That his excellency lite governor is hereby au thorised to appoint some fit ami proper person as Agent, whose duty it Uiall be to see that the pro visions of this act be duly and cirectually carried into opera'ion. and to ex mine a. d report to his excellency the governor, such hits having I ndum improvements thereon, and subject to be granfed by this act; wdio shall receive one thousand dol lars per annum, as a full compensation f-or his ser vices, and who shall take and subscribe ihe follow ing oath, to wit : *• i A. Superior Court, in any county where lie shall violate or neglect to pert<inn the dunes req..iired of him. as agent as aforesaid : 1 and on conviction thereof, he shall be removed from office, and be fined at the discretion of the court. Sic. 14. And be it further enact'd, That if any person shall by threats, menaces oi otherwise, deter or prevent any Indian or Indians from enroling for emigration, he or they’, shall be held and deemed guihy of a misdenicanour. ami on conviction thereof, shali be fined in a sutnj not less than one hundred dollars nor more than five hun dred dollars, or undergo an inipiisonnicJit iu the Penitentiary at the discretion of the court. Sec. 15. And be it further enacted That all laws and parts of laws, militating against this a'-t, and the act appointing special ag-encies for tin counties, be, and ihe same are hereby re pealed.
