Its unknown in the history of poll lies. It is incompa tible with the very nature of government. Authority is the principal ingredient, and without it, there can be no government at ail. Bnt those who insist upon ’hr: veto right in the Slates, seem to view the Union as, completely federative, that what is done by the General, Government, must receive the sanction of the States,' either express! y or impliedly, or the act will be null' and void. This in substance, is what is contended, for. Because ifa law is enacted by Congress, and al State be dissatisfied, and declare it unconstitutional and inoperative within her limits, she may be considet-i ed as having refused to sanction the law proposed by Congress. But in the event ll ai she does not make tin i objection, t it is then ur>derst< od that she has given s tacitassent, ami therefore tne law goes into operaiim.! We conceive that both ihe reason and spirit of the! Constitution, as well as its strict letter, disproves tin* position. What was th>- reaym and moving spirit j Which induced the people of the several States to adopt! the present Constituiirm ? It was for the purpose *>fj giving such laws as might be made by their common! Council, a binding effect upon every State, without cal-j ling upon tin m for their sanction. The states had! tried a coofederaov for several years, and the experi-| tment proved to them, that it was necessary tocreatea! General Government, clothed with sufficient authority | to carry its enactments into execution. It was found! that many of the laws proposed by the old Congress,! failed to receive the sanction of all the States. An<i| why? Because there existed so many local and prejudices, and diversity of interests in a country* so widely extended as ours, tha' it was found to be ai-S tn si impossible to enact any general law f>r the.Unmn, j where it bad to be assented to by so many diflerer t| councils. A remedy of this evil was the p-mcipalj moving cause, which induced the people of the sei er-j al States to adopt our present form of government. Upon looking into the Constitution we find that the veto principle is expressly prohibited. That instru ment declares, that *• this Constitution and the laws of the United S'atcs, which shall be made in pursu ance thereof, and all treat ice made or which shall be made, under the authority of the United S'atcs, shall be the supreme law of the land; nnd the Judges of ev ery State, shall be bound thereby, any thing in the Constitution or laws ofany State, »o trie contrary, nol g withstanding.” This clause positively forbids States interposition, either in the form of a Convention <'*•» law, enacted by a state Legislature. We have chosen this tribunal to decide in the last resort, cases arising under the Constitution and laws of Congress, treaties made, &.c. And where is the great objection ?
