Debt (the "Security Deed") from
LARRY ALLEN WILSON, JR. and
BETTY LOUISE WILSON, as Gran
tor, to SEVILLE MODULAR, LLC, as
Grantee, dated November 22, 2005,
recorded in Deed Book 3671, Pages
350-355, Deed Records of Houston
County, Georgia, said Security Deed
being given to secure a certain
promissory note of even date there
with in the original principal amount
Of FIFTY-NINE THOUSAND EIGHT
HUNDRED EIGHT AND 52/100
DOLLARS ($59,808.52) (the
"Note"), with interest thereon as pro
vided in said Note until paid, to
gether with any and all renewals and
extensions thereof, in whole or in
part, but also any and all other and
further indebtedness owing by the
Grantor to the Grantee, its succes
sors and assigns, there will be sold
by the undersigned at public outcry,
during the legal hours of sale before
the Courthouse Door of Houston
County, Georgia, on the first Tues
day in October, 2007, to-wit: Octo
ber 2, 2007, to the highest and best
bidder for cash, the following de
scribed property:
All that tract or parcel of
land situate, lying and being in Land
Lots 70 and 71 of the Fifth Land Dis
trict of Houston County, Georgia,
known and designated as Lot 42,
Block "H", Phase No. 3, Section No.
2, of a Subdivision known as RICH
MOND HILL, according to a plat of
survey of said Subdivision prepared
by Waddle & Company, certified by
Theodore W. Waddle, Jr., Georgia
Registered Land Surveyor No. 2139,
dated August 7, 2003, revised Sep
tember 10, 2003, a copy of which is
of record in Map Book 61, Page 92,
Clerk's Office, Houston Superior
Court. Said plat and the recorded
copy thereof are hereby made a part
of this description by reference
thereto for all purposes.
The debt secured by said
Security Deed has been and is
hereby declared due because of,
among other possible events of de
fault, the failure of the Grantor to
pay as and when due the indebted
ness evidenced by the Note secured
by said Security Deed. Notice has
been given of intention to enforce
provisions for collection of attorney's
fees in accordance with the legal re
quirement and the terms of the Se
curity Deed. The debt remaining in
default, this sale will be made for the
purpose of applying proceeds
thereof to the payment of the indebt
edness secured by the Security
Deed, accrued interest and ex
penses of the sale and other sums
secured by the Security Deed, in
cluding attorney's fees, and the re
mainder, if any, shall be applied as
provided by law.
To the best of the under
signed's knowledge and belief the
property is in the possession of
LARRY ALLEN WILSON, JR. and
BETTY LOUISE WILSON, or their
successors in interest, and said
property will be sold as the property
of the said LARRY ALLEN WILSON,
JR. and BETTY LOUISE WILSON.
Said property will be sold subject to
all unpaid ad valorem taxes, special
assessments, any unpaid utility bills
constituting liens against the prop
erty, and all restrictive covenants,
easements and other matters of re
cord superior to and existing at the
