executed a Deed to Secure Debt in
favor of SECURITY BANK OF
HOUSTON COUNTY, securing a
note of even date in the original prin
cipal amount of $239,000.00, said
indebtedness being due and pay
able in accordance with the terms
and conditions contained in said
note, and said Deed to Secure Debt
being of record in Deed Book 3319,
Pages 328-330, Clerk's Office,
Houston County Superior Court.
By virtue of the power of
sale contained in said Deed to Se
cure Debt, there will be sold by the
undersigned at public outcry to the
highest and best bidder for cash be
fore the Courthouse door of Houston
County, Georgia, within the legal
hours of sale, on the Wednesday af
ter the first Tuesday in January,
2008, same being January 2, 2008,
all of the following described prop
erty:
TRACT 1: All that tract or
parcel of land lying and being in the
13th Land District of Houston
County, Georgia, and in Land Lots
95 and 116 therein, known and des
ignated as "AXYD" on a play of sur
vey made by Rhodes Sewell, Sur
veyor, on September 17, 1957, and
revised on August 2, 1962, to show
said tract of land herein conveyed, a
copy of said plat being of record in
Map Book 7, Page 271, Clerk’s Of
fice, Houston Superior Court. Said
plat and the recorded copy thereof
are hereby made a part of this de
scription by reference thereto. Said
land is further described as follows:
BEGINNING on the south
east side of the Grovania to Haynev
ille public road at point A in Land Lot
116; thence in a northeasterly direc
tion along the southeast line of said
road for a distance of 223.5 feet to a
point X; thence South 63 degrees 58
minutes East for a distance of 261
feet to point Y; thence South 14 de
grees 44 minutes West for a dis
tance of 225 feet to point D; thence
North 63 degrees 58 minutes West
for a distance of 322.5 feet to point
A, the place of beginning. Said land
is bounded generally on the South
by land of Shade Brown; on the East
by land of J. D. Abrams; on the
North by land of Freeman Jenkins
which is also shown on said de
scribed plat of survey; and on the
East by the Grovania to Hayneville
public road.
Said described property is
a part of that property conveyed
from James L. Dukes and wife, Mrs.
Louise M. Dukes, to Freeman
Jenkins by deed dated September
20, 1957, and recorded in Deed
Book 117, page 99, Clerk's Office,
Houston Superior Court.
TRACT 2: All that tract or
parcel of land lying and being in the
13th Land District of Houston
County, Georgia, and in Land Lot 95
therein, known and designated as
Tract ”B" on a plat of survey made
by Rhodes Sewell, Surveyor, on
September 17,1957, and revised on
August 2, 1962, a copy of said re
vised plat being of record in Map
Book 7, page 271, Clerk's Office,
Houston Superior Court. Said plat
and the recorded copy thereof are
hereby made a part of this descrip
tion by reference thereto.
A dwelling house and
other improvements are located on
said land.
TRACT 3: All that tract or
parcel of land situate, lying and be
ing in Land Lot 95 of the Thirteenth
Land District of Houston County,
Georgia, same being more particu
larly known and described as Parcel
"B", comprising 11.22 acres and
having such shapes, metes, bounds,
courses and distances as are shown
on plat of survey captioned "Prop
erty of Stewart I. Bloodworth" pre
pared by Richard L. Jones, Regis
tered Land Surveyor No. 1591, said
plat of survey dated March 27, 1985,
and of record in Plat Book 27, Page
295, Clerk’s Office, Houston Supe
rior Court. Said plat of survey and
the recorded copy thereof are
hereby made a part of this descrip
tion by reference thereto for all pur
poses.
The debt secured by said
deed to secure debt has been de
clared due because of default in the
payments thereon, and in the due
performance of the covenants
therein contained, including pay
ment ad valorem taxes. The debt re
maining in default, this sale will be
made for the purpose of paying
same and all expenses of the sale,
including reasonable attorney's fees.
Said property shall be
sold as the property of Marcus T.
Morgan and his successors in title,
subject to outstanding ad valorem
taxes, easements, and other matters
as will otherwise appear on the pub
lic records in Houston County and
other restrictions of record. To the
best of the undersigned's knowledge
and information, the above de
scribed property is presently in the
possession of Marcus T. Morgan.
WHEREAS, the giving of
notice in compliance with O.C.G.A.
Sections 44-14-162 - 44-14-162.4
was not required as the property
conveyed by the aforementioned
deed to secure debt was not used
as a dwelling place by the debtor at
the time the deed to secure debt
was entered into.
The undersigned will exe
cute a deed to the purchaser at said
sale as provided in the aforemen
tioned deed to secure debt.
