Repair shop makes it hard to 'keep on truckin'

shop off

The “Law” man
few days later, they told
me that my engine need
ed to be replaced. But
I believe the mechanic
blew up my engine (it
was on fire). It will cost
me over $16,000 to have a
new engine put in my rig.
What do I need to do?

Bob, a friend, has encoun
tered a situation he never
anticipated. Bob works at a
manufacturing facility - one
of the most productive, high
est quality, lowest cost plants
of its kind. Leaders from
other organizations visit just
to observe how it’s done.
Unfortunately, demand
for the product has taken
a significant downturn. The
entire industry is feeling the

Dear Reader, You may
find yourself in a very dif
ficult situation. Your vehi
cle insurance probably only
covers your rig for property
damage caused by a wreck
or theft, not for negligent
repairs.
Hence, you will probably
need to sue the repair shop,
if you want any help in cov
ering the cost of the repairs.
That may prove easier said
than done.
If you were to sue, you
would be suing for negli
gence in the breach of the
written or unwritten con
tract you had with the shop
for the repairs. You have
to show that the mechanic
did something negligent in
trying to repair your rig; it
is probably not enough to
just show that the engine
blew up in the custody of the
years, Bob is being invited by
his company to seek employ
ment elsewhere.
The challenge you face is
likely not this severe. Still,
you can use the same per
spectives I’m offering to Bob.
Further, these two concepts
apply whether the challenge
you face is one you are ini
tiating or one that has been
thrust upon you.
Here are two simple ideas
that will empower you to
move forward with confi
dence. Imagine deeply the
outcome you’d like to gener
ate. And act as if your behav
iors are guaranteed to make
it happen!
Imagine deeply. The
human brain cannot tell
the difference between
an event vividly imagined
and one actually experi
enced. Further, your great
est opportunity for success
occurs when you have men
tally simulated the behav
iors you believe will lead to
your desired result.
I role-play experiences
with my clients, so that they
“practice” in a safe environ
ment where errors carry no
consequences. I invite them
to imagine both the desired
outcome and the behaviors
most likely to produce that
effect.

From your inquiry, I don’t
know the exact condition of
the rig’s engine, nor what
was wrong with it that
caused you to have it towed
to the repair shop. Nor do we
know exactly what caused
the engine catch fire.
These are critical facts and
I would HIGHLY recommend
that you have the destroyed
engine analyzed by an inde
pendent mechanic, who is
willing to testify, about the
cause of the engine-fire.
Assuming that you can
not identify the direct link
between negligence and the
engine-fire, or what was
done to cause it, you may
be able to prove negligence
indirectly.
There is something under
the law called “res ipsa loqui
tor,” which,' loosely trans
to become what we imag
ine ourselves to be. So, Bob
is envisioning effective ini
tial contacts with potential
employers. He is practicing
interview responses that
describe his most effective
past work. He is imagining
the interviewer’s positive
impressions being captured
in his written comments.
Act as if. When you face
challenges, you may initially
lack confidence. Your self
doubts may make it diffi
cult to imagine positive out
comes! Yielding to feelings
of uncertainty, however,
is guaranteed to prevent
you from taking beneficial
action.
Most of us want to “feel”
confident before we “act”
confident. But that is wrong
thinking! Studies have
shown that if you act confi
dently, the feelings of confi
dence follow. Try it for your
self!
First, spend five minutes
with shallow breathing,
back and shoulders slumped,
and eyes downcast. Note
how you feel. Then spend
five minutes standing erect,
speaking energetically, eyes
focused, and hands gestur
ing broadly. Now, how do
you feel?
What is “cause” and what
is “effect” is often hard to
to enter in causing infec
tion.
A person with high
blood sugar has a harder
time healing the infected
area and may allow the
infection to spread.
An infection can reach
all the way through the
skin, underlying tissues
and can even spread to
the bones and joints.

en. Essentially, you rule out
any other explanations and,
what is left, is negligence as
the only explanation.
In your case, let’s say that
you brought the rig in to
work on the brakes. I would
expect a mechanic would
testify that there is no rea
son to work on the engine to
fix the brakes.
Of course, that still does
not explain why the engine
blew up.
Thus, the repair shop
could still try to argue that
it was not responsible for
the engine fire, e.g., that
there was some other cause
other than repair negligence.

didn’t say it would be easy.
But proper thinking is with
in your control!!
Give it a try. Imagine deep
ly the outcomes you desire.
Act as if your behaviors are
sure to lead you there. You’ll
find yourself confidently
moving in the direction of
your greatest expectations.

There is one more twist
to your case that will com
plicate things: Jurisdiction.
The Florida repair shop can
not be sued in Georgia. If
you want to sue, you will
need to sue in Florida, prob
ably in the county where the
repair shop is located.
This means that if you
were to sue, you need to cal
culate the cost of hiring an
attorney in Florida id trav
eling down there for court.
In the end, you may find
that suing does not make
practical sense and it is
cheaper to just fix the engine
yourself. I wish I had better

Natural Gas Safety
The City of Warner Robins provides natural gas to residential
and commercial customers. If you think you may have a gas
leak in your home or office you should immediately notify
the City Utility Dept, at 478-929-1903 or call 911. Because
natural gas does not have any smell or color, the City adds
a special odor to the gas which is very strong and smells like
sulfur or rotten eggs. Natural gas is normally very safe, but
if gas leaks for a long time, or if a leak is very large, it can
become dangerous in a closed-in area. The city puts enough
odorant into the gas so that you will smell it long before a
leak becomes dangerous. However, you should always call
right away and allow trained inspectors to safely check your
building, even if the odor seems weak. If the odor is sudden
and very powerful, you should leave the building and call
