tain Deed to Secure Debt from
Caudell-White Properties, LLP
("Debtor") to Sun Trust Bank ("Sun-
Trust"), dated March 27, 2001, and
recorded on- March 29, 2001, in
Deed Book 1713, Page 48, with the
Clerk of the Superior Court of Hous
ton, Georgia (the "Records"), as as
signed by Sun Trust to DCR Mort
gage 111 Sub I, LLC ("Lender") pursu
ant to Absolute Assignment and As
sumption of Deed to Secure Debt
and Loan Documents, dated as of
February 28, 2007, and recorded in
Deed Book 4226, Page 184, afore
said Records, said Security Deed
being given to secure a Promissory
Note of even date as the Security
Deed in the original principal amount
of One Million One Hundred Twenty
Thousand Five Hundred Dollars
($1,120,500.00), and a Promissory
Note dated April 30, 2002, in the
original principal amount of One Mil
lion One Hundred Seventy-Five
Thousand Two Hundred Dollars
($1,175,200.00) with interest from
the respective dates of the Promis
sory Notes at the respective rates as
provided therein on the respective
unpaid balances until paid, as said
Promissory Notes were subse
quently modified, as said Security
Deed was subsequently modified by
Modification of Deed to Secure Debt
and Security Agreement dated Feb
ruary 19, 2002, and recorded in
Deed Book 2019, Page 05, afore
said Records, and as said Security
Deed and Promissory Notes were
subsequently modified by that cer
tain Forbearance Agreement by and
among Debtor, R. Elliott Caudell and
R. L. White, on the one hand and
Sun Trust on the other hand, dated
April 27, 2005, as said Forbearance
Agreement was subsequently modi
fied and amended, and by that cer
tain First Consolidated Amendatory
Agreement between Debtor and
Lender, dated as of February 28,
2007, and recorded in Deed Book
4226, Page 188, aforesaid Records
(said Promissory Notes, as so modi
fied an assigned, are herein called
the "Notes”, and said Security Deed,
as so modified and assigned, is
herein called the "Security Deed");
there will be sold by the undersigned
at public outcry, to the highest bid

The above described prop
erty is the same property as de
scribed in that certain Warranty
Deed from Terry B. Horton and Re
becca M. Bullock, individually and
as Executrix and Trustee of the Es
tate of George E. Bullock to
Caudell-White Properties, LLP,
dated January 4, 2001, recorded in
Deed Book 1659, Pages 248-251,
Houston County Deed Records.
Together with the remain
der of the "Property," as defined in
the Security Deed, including, without
limitation, the improvements, fur
nishings, fixtures, equipment, ma
chinery, appurtenances, rights, inter
ests, estates, leases and personal
property associated with the
above-described real estate.
The Real Property or its
address is commonly known as 220
Carl Vinson Parkway, Warner
Robins, GA 31088.
The entire indebtedness
evidenced by the Notes and secured
by the Security Deed has become
and has been declared due and
payable in full because of certain
defaults and events of default by
Debtor under the Notes and the Se
curity Deed, including, without limita
tion, Debtor's failure to make pay
ment of the indebtedness evidenced
by the Notes and secured by the Se
curity Deed and failure to comply
with other terms of the Notes and
Security Deed. Said indebtedness is
and remains unpaid, and said de
faults and events of default continue
to exist under the Notes and the Se

curity Deed. The Notes and the Se
curity Deed remaining unpaid and in
default, this sale will be made for the
purpose of applying the proceeds of
such sale in the manner required by
the Security Deed and by Georgia
law, including without limitation at
torneys' fees (notice of intent to col
lect attorneys' fees having been
given).
Said property will be sold
as the property of Debtor on an "as
is, where is” basis without recourse
and without representation or war
ranty, express or implied, of any na
ture whatsoever with respect thereto
and will be sold subject to any out
standing ad valorem taxes (including
taxes which are a lien, but not yet
due and payable), any matters
which might be disclosed by an ac
curate survey and inspection of the
property, any assessments, liens,
leases, encumbrances, zoning ordi
nances, restrictions, covenants, and
other matters of record superior to
the Security Deed.
To the best knowledge
and belief of Lender, the described
property is in the possession of
United States of America, General
Services Administration, as tenant
under a certain Lease.
