Inc. executed a Deed to Secure
Debt in favor of Planters First, secur
ing a note of even date in the origi
nal principal amount of $130,561.50,
said indebtedness being due and
payable in accordance with the
terms and conditions contained in
said note, and said Deed to Secure
Debt being of record in Deed Book
3768, Pages 163-170, Clerk's Of
fice, Houston County Superior
Court.
By virtue of the power of
sale contained in said Deed to Se
cure Debt, there will be sold by the
undersigned at public outcry to the
highest and best bidder for cash be
fore the Courthouse door of Houston
County, Georgia, within the legal
hours of sale, on the first Tuesday in
July 2008, same being July 1, 2008,
all of the following described prop
erty:
All that tract or parcel of
land situate, lying and being in Land
Lot 230 of the 13th Land District of
Houston County, Georgia, and in the
City of Perry, being known and des
ignated as Lot 1, Block "J", Brendale
Subdivision, Section 3, as is more
particularly shown on a plat of sur
vey entitled "Subdivision Plat for
Brendale Subdivision, Section 3",
prepared by Lee R. Jones, Georgia
Registered Land Surveyor No. 2680,
dated February 6, 2006 and re
corded in Plat Book 66, Pages
122-123, Clerk's Office, Houston
Superior Court. Said plat and the re
corded copy thereof are hereby
made a part of this description by
reference thereto for all purposes.
The debt secured by said
deed to secure debt has been de
clared due because of default in the
payments thereon, and in the due
performance of the covenants
therein contained, including pay
ment ad valorem taxes. The debt re
maining in default, this sale will be
made for the purpose of paying
same and all expenses of the sale,
including reasonable attorney's fees.
Said properly shall be
sold as the property of Pete Stokes
Builders, Inc. and its successors in
title, subject to outstanding ad valo
rem taxes, easements, and other
matters as will otherwise appear on
the public records in Houston
County and other restrictions of re
cord. To the best of the under
signed's knowledge and information,
the above described property is
presently in the possession of Pete
Stokes Builders, Inc.
WHEREAS, the giving of
notice in compliance with O.C.G.A.
Sections 44-14-162- 44-14-162.4
was not required as the property
conveyed by the aforementioned
deed to secure debt was not used
as a dwelling place by the debtor at
the time the deed to secure debt
was entered into.
The undersigned will exe
cute a deed to the purchaser at said
sale as provided in the aforemen
tioned deed to secure debt.
