Sale contained in the Deed to Se
cure Debt fipm Pete Stokes Build
ers, Inc. to Branch Banking and
Trust Company, dated March 31,
2005 and recorded in Deed Book
3362, Pages 36-43, Clerk's Office,
Houston Superior Court, there will
be sold by the undersigned, Branch
Banking and Trust Company, at
public outcry to the highest bidder
for cash, before the courthouse door
in Houston County, Georgia, within
the legal hours of sale, on the first
Tuesday in July, 2008, the following
described property, to-wit:
All that tract or parcel of
land situate, lying and being in Land
Lot 190 of the 13th Land District,
City of Perry, Houston County,
Georgia, as is more particularly
known and designated as Lot 2,
Constance Court Subdivision, ac
cording to a plat of survey prepared
by Lee R. Jones, Georgia Regis
tered Land Surveyor No. 2680,
dated December 28, and recorded
in Plat Book 61, Page 171, Clerk's
Office, Houston Superior Court.
Said plat and the recorded copy
thereof are hereby made a part of
this description by reference thereto
for all purposes.
Said Deed to Secure Debt
having been given to secure a Note
dated October 24, 2005, as Modified
by Note Modification Agreement
dated October 5, 2007, which Note
and the Modification have become
in default as to principal and inter
est, the entire remaining indebted
ness under said Deed to Secure
Debt has been declared due at once
because of, among other possible
events, failure to make payments
due in accordance with the terms of
said Note and modification, there
upon the Power of Sale contained in
said Deed to Secure Debt became
operative. A copy of this notice of
sale has been given to the debtor as
required by O.C.G.A. §44-14-162.1.
The debt remaining in default, this
sale will be made for the purpose of
paying the same and all expenses of
this sale, including attorney's fees.
Said property will be sold
as the property of Pete Stokes
Builders, Inc. and subject to ad valo
rem taxes, restrictive covenants and
assessments of record, if any.
The purpose of this is to
collect a debt, and any information
obtained will be used for that and
other purposes allowed by law.
