The Real Property will be
sold together with all buildings,

every nature whatsoever now or

limitation, all heating, air condition
ing, lighting, central vacuum, and
security systems, shutters and other

on an "AS IS, WHERE IS" basis
without recourse against Lender and
without representation or warranty of
any kind or nature whatsoever with
respect thereto, with no assurance
afforded to the exact acreage con
tained in the Real Property descrip
tion and subject to all of the follow
ing, without limitation: (a) all out
standing taxes, assessments, and
utility bills which are valid liens and
encumbrances upon any of the
Property and which are prior in right
to the liens and security interests of
Lender (including taxes which are
liens, but not yet payable); (b) any
and all easements, restrictions,
covenants, encumbrances and other
matters which would be revealed by
an inspection or accurate survey of
the Real Property; (c) all valid zon
ing ordinances; (d) rights of tenants
under recorded and unrecorded
leases; (e) all federal tax liens (if
any) affecting any of the Property
and the right of the United States
Government relative thereto, includ
ing, but not limited to, the right of re
demption of the United States Gov
ernment, if any such rights validly
exist; and (f) any and all easements,
limitations, restrictions, reservations,
covenants and encumbrances of re
cord to which the Security Deed is
subordinate in terms of priority.
The proceeds of the sale
of the Property will be applied in ac
cordance with the Security Deed to
the payment of the indebtedness
owed to Lender under the Security
Deed and the Note, including taxes
and insurance premiums and attor
neys' fees, with interest thereon,
and to the payment of all expenses
of sale, to the ektent provided by
Georgia law. Lender reserves the
right to credit bid at the sale all or a

Because of a default in
the payment of the indebtedness se
cured by a Security Deed executed
by Juan Pena and Jeannine Card to
Washington Mutual Bank, FA dated
March 30, 2007, and recorded in
Deed Book 4236, Page 247, Hous
ton County Records, securing a
Note in the original principal amount
of $93,280.00, the holder thereof
pursuant to said Deed and Note
thereby secured has declared the
entire amount of said indebtedness
due and payable and, pursuant to
the power of sale contained in said
Deed, will on the first Tuesday,
August 5, 2008, during the legal
hours of sale, before the Courthouse
door in said County, sell at public
outcry to the highest bidder for cash,
the property described in said Deed,
to-wit:
All those tracts or parcels
of land situate, lying and being in
Land Lot 140 of the Fifth Land Dis
trict of Houston County, Georgia,
being known and designated as Lot
23, Phase 1, of Boone's Bradford
Park Subdivision, according to plat
of survey of said subdivision pre
pared by Mid-State Engineering &
Surveying, LLC, certified by Edwin
E. Ledford, Georgia Registered
Land Surveyor No. 2340, dated July
21, 2004, last revised September
23, 2004, a copy of which is of re
cord in Map Book 63, Page 44,
Clerk's Office, Hquston Superior
Court. Said plat and the recorded
copy thereof are hereby made a part
of this description by reference
thereto for all purposes.
The above-described prop
erty is conveyed subject to Declara
tion of Covenants, Restrictions,
Easements and Assessments, as
contained in instrument of record in
Deed Book 3186, Pages 323-337,
Clerk's Office, Houston Superior
Court; also, subject to easements
and rights-of-way for public roads
and utilities as they now exist, and
building lines and other matters
shown on the aforesaid recorded
plat of survey.
Said property is known as

tures and personal property at
tached to and constituting a part of
said property, if any.
