week, prosecutors
in Colorado defini
tively cleared the Ramsey
family in the death of Jon-
Benet.
The sad story of her death
in the Ramsay house on the
day after Christmas has,
unfortunately, been a staple
of tabloid news for the past
several years.
Still, I found this last news
report interesting for a dif
ferent reason - because it
illustrates how deeply DNA
evidence continues to creep
into our legal system.
The evidence analysis
clearing the Ramsey family
was from a drop of blood and
some “transfer” skin cells
left on the little girl’s clothes,
presumably, by her attacker.
The latter, frankly, is
something I had not heard
of before and is, apparently, ,

This article is not about
“time management,” though
many leaders need major
help in this area! This article
is about your decision-mak
ing power! You decide, every
day, every moment, how you
will invest the irreplaceable
resource - your t ime!
Will you apply it wisely,
accomplishing any of dozens
of possible achievements?
Or will you fritter it away?
Or maybe worse, will you
behave in a way that will
require follow-up rework
later?
Your choice of how to
use your time and energy
is often not conscious. If it
were, you’d likely use your
time and energy better. You’d
not watch that extra hour of
television. You’d read and
exercise more frequently and
vigorously. You’d do some

of civic concern, ignorance
and the philosophy of “if it isn’t
broken don’t fix it” prevailed.
Fortunately and luckily,
what we are receiving could
be even worse but also bet
ter! The latter should have
prevailed as excellence would
be the best result.

Monday. I am outraged at
the comment printed in your
paper Wednesday that the
search “wound up costing the
city a good deal of time and
trouble." If it were one of their
own, the search would have
been taken more seriously,
but since the great people
who showed up NEVER set
foot in the woods and could
not take credit for the rescue
of those children, it became a
waste of time and effort.
I was on the scene of the
area where post command
was set up and I can tell you
of the so-called efforts that
were made by search and
rescue. The time it took for
them to prepare and gather
their team and set a plan
of action should make the
citizens of Houston County
worry about their own safety
should the need arise in any
emergency.

up a great sweat), and

controversial. What is hoped
is that the sick killer of Jon
Benet will eventually be
arrested and his or her DNA
will end up being added to a
DNA database.
Unfortunately, the chances
of this happening are rather
slim. A national DNA data
base is growing, but only in
fits and starts. There are
legitimate concerns about
what will be done with this
information and even what
information should be kept

Should everyone arrested,
for any crime, have their
DNA added to a national
database? Should samples be
mandatory only from those
convicted? Or should sam
ples only be taken from those
convicted of certain crimes?
As with the Ramsey fami
ly, DNA clears not only those
who have never been actually
charged with a crime, it has
also corrected some horrible
injustices. It seems like every
month, we hear of another
wrongfully imprisoned poor
soul, who has a decades-long
nightmare ended by post
conviction DNA testing.
Yet, in many jurisdictions,
post-conviction laws prohibit
challenging convictions on
the development of more
sensitive DNA testing. Who
should have access to this
right? Who pays for it?

Since then, I’ve realized
that I presumed thiat we
always consciously consider
all our options. Not so for
most of us! I now am aware
that we often are not even
sensitive to many of our pos
sibilities.
The number of lost oppor
tunities is far greater than
most of us realize.
Two weeks ago, I wrote
that there are at least five
different ways to respond
to any situation. I contend
that when it comes to our
use of time, we only consider
the proverbial “tip of the
iceberg.”
Let me speculate. Imagine
you hire three highly respect
ed “time management”
consultants. Allow each to
observe you for three full
days. Then let them spend
two days interviewing your
customers, suppliers, staff,
and family. Ask each to pro
vide an independent recom
mendation for the top five
most important activities for
your upcoming week. I’ll bet
you receive at least a dozen
different recommendations!
Whether I’m right or not
isn’t the point. My objective
is to raise your awareness.
I want you to realize that
there are dozens of opportu
nities available to you every

DNA plays a key role in
other parts of the justice
system - paternity actions.
A decade ago, proving par
entage was something of a
crap shoot. Courts relied on
the credibility of witnesses,
imprecise blood-typing com
parison, and circumstances
to determine if a purported
father was indeed related to
a child.
The uncertainty built into
this evidence has led to some
pretty horrific results, when
mistakes were discovered
years later.
One man in Georgia, after
paying child support for over
a decade, sued, albeit unsuc
cessfully, for fraud when he
learned that the mother had
lied about him being the
father.
With relatively inexpensive
DNA testing, often paid for
by the State, such possibili
dav that you never even con
sider!
Periodically, I review
how I’m spending my life.
I strongly encourage you to
do the same. Whatever age
you are, in 10 years, you’ll
never be able to go back and
recapture those lost oppor
tunities!
I wish I could find the
article that convinced
me, at age 50, to take a
year of travel through the
United States and Canada.
The writer suggested that,
though we humans regret
our mistakes, we regret even
more the attractive alterna
tives we never attempt. My
wife and I had saved for five
years to make that trip. My
father kept saying, “Do it
while you are young enough
to enjoy all that driving!”
I followed the advice of
Dad and that article. Hiking
in most of North America’s
national parks was an amaz
ingly memorable experience.

dren and, wrongly accused
men, who now know parent
age from the beginning and
with some comfort that the
results are accurate.
However, the problem
with DNA testing, and the
epidemic of CSI clone TV
programs, is that the gen
eral public has been given
a false sense of “certainty”
in the trial process. We see
intrepid investigators find
ing “evidence” in the most
improbable of circumstances
and come to believe this is
standard police crime scene
practice (it is not) and that
all of these “tools” are avail
able to all police departments
(hah!).
What we have to remember
is that the judicial process,
even in trying to identify
your time, energy?

prosecutors, defense attor

sort through fact versus con
jecture and try to get at the
“Truth.”
Too often this process is
visited by knee-jerk reactions
of “guilt”(remember the
Duke Lacrosse students?).
Thankfully, the cloud of sus

family has been lifted.
