History of Lawrenceville Anti-Jug Ordinance.

Dear Sir: Replying to your request, I you briefly the history of
the anti-jug ordinance, enacted in Lawrenceville by my brother, L. M.
Brand, during his administration as mayor of Lawrenceville:
He, himself, without any suggestions from me, and without my know
ledge, drew tand had adopted the first ordinance upon this subject. That
ordinance imposed a tax of one thousand dollars on any railroad company,
express company, or any one else delivering intoxicating liquors within the
incorporate limits of the city of Lawrenceville. This ordinance was passed
by the city council under the charter of the city of Lawrenceville, as it
then existed.
He claims that authoiity to enact this ordinance is given under each of
several sections of the Act of 1904, paee 489. Said sections sneciallv sriv
ing this authority, were numbers 1-32-48-28 and 30, besides the general
welfare clause.
The Supreme Court, in the 124 Georgia, page 581 to 596, in passing
upon this ordinance, and holding it invalid, construes all these sections in
the light of this ordinance, and held:
First, That a common carrier is bound to receive all goods offered it
for transportation, which it is able and accustomed to carry, upon comnli
ance with such reasonable regulations as it may adopt for its own safety
and the benefit of the public. (

Second, That said ordinance is void as the mayor and council of said
city had no power under charter to enact such an ordinance.
In the meantime, I, for fear that the Supreme Court would hold that
our charter was not sufficient to authorize the enacment of this ordinance,
I, myself, as a citizen and taxpayer of Lawrenceville and Gwinnett county,
on my own responsibility, and without any employment by the city, pre
pared an amendment to said charter which I gave to one of our representa
tives in the legislature, who had the same enacted into law. My object was
to supply the defect, which I apprehended the Supreme Court would decide
was in the original charter, and, also, to give Lawrenceville full authority
to enact any ordinance it saw proper in reference to the liquor traffic.
That amendment is as follows:
“Said mayor and council are hereby further authorized and empow
ered, in the exercise of the police power of said city, to enact ordinances
preventing the delivery within the corporate limits of said city, of wine,
beer, whiskey or other intoxicating liquors, by any corporation, company,
partnership, or by any other person, or persons, directly or indirectly,
and to enact ordinances providing for a penalty for so doing. Said city is
further authorized and empowered’ to enriet ordinances preventing any
company, corporation or person whatever from receiving such intoxicants
within the corporate limits of said city from any coiporaton oh* person,
whomsoever, and to enact ordinances providing for a penalty for so doing.
