prosecute a man for stealing your
whisky.
At Jeast that’'s what Judge Johin
D. Humphries of the Fulton Superior
court, ruled Monday morning in the
trial of a city detective charged wii
having purloined 87 quarts of ligl
uvor from a selflconfessed Lootlegger
Judge Humphries rulled that whis:
ky has no legal status having been
legislatively outlawed by federal en
actment and state law. Therefore
it cannot be regarded as property by
the statutes and no prosecution can
be instituted against a person whe
steal from another.
However, savs Judge Humphries, al
thongh you ean’t prosecute the tellow
who steals vour liquor, yon can have
him sent up for violating the prolibi
tion law. If he steals your whisky, he
necessarily has it in his possession and
the mere fact of possession is a viola
tion of the law.
So, it appears, there is some halm
in Gilead after all.
Judge Humphries’ ruling emme dur
ing the trial of Lon Terry, a eity de
tective, indieted on the charge of steal
ing 87 quarts of liquor from Clarence
Hart, who has admitted that he was a
blind tiger and hootlegger. Oscar How
ell, another detective, is also under in
dictment on the same charge in the
same ease,

conditions will continue to improve
according to a statement by Archel
Wall Douglas of the Chamber of
Cemmerce of the United States. \
Reports brought in by the traceling
salesman show that business men of
the nation are confident that busi
ness will he better in the spring, ac
cerding to Douglas.
“All are agreed that the only way
to hasten matters is by the general
exercise of the homely virtues of
hard work and economy,” Douglas
says the South intends to illustrate
this year by raising the cheapest
cotton crop in years, a crop grown
on a corn meal and syrup diet system
of expense.

betore 8 o'clock tonight shot and
killed Cone Jjohnson also known by
the name of Callie Aikens 30 year:
of age, killing her, Atkiis then turned

hole into his left temple. He died on

ke hoped that no technicailties will
prove troublesome; hut in the event
they do, the law should be speedily
purged of them.

WAY TO GIVE BOND

United States Deputy Marshall A, M
Kea who was indicted by the United
States grand jury in Savannah leif
here this morning in an automobile
for savannah to give hond. He was
accompanied by his brother.
Kea stated to newspaper men here
he is absolutely innocent of the
charges. HHe says he has accepted
no money from men alleged to wio
lating the prohibition law to protect
them. He charged the statement on
the men upon whose evidence he way
indicted were madde for the pwm
pos of geting even with him for vig
orously prosecuting his duty.
The former marshall said that
while deputy marshall at Savannah
he did his duty at all times to the

Kea should arrive in Savannah thi
afternoon.
HENRY ELDRED KILLED BY
TRAIN AT TERRE HAUTE
Henry Eldved, age 27, who was an in
ficlder with Albany in the Georgin
State League in 1906, and will he re
membered by many old Cordele fans,
died in a Terrve Haute hospital recently
from injuries received when struck by
a train at a grade crossing east of that
city. ¢
Eldred was very clever as » hall
plaver and exeeptionally popuiar with
associates and fans.
He came to the Albany team from
Meridian in the (Cotton States Leagne
and later played with fast and semi
pro teams around Chicago, Milwaukce
amd his home town, Terre Hauto.
