Tracey Found Guilty }

. Tracey, notorious bandit, was found
guilty of second degree murder,for}
. the slaying of a negro taxicab driver!

PORT HURON, Mich., April 30—
Returning after an absence offour
years to find he had been recordad
as dead; his former wife married to
another man and the $lO,OOO life
insurance he had carried used by his
former wilf to erect an apartment
house bearing his name out of re
spect to his memory, Adelaide Le
bert, 53 years old, has started an
investigation. -
Four years ago Lebert disappeared!
after a quarrel with his wife, He was
registered as missing and officers
throughout Michigan joined in the
search for him, his wife having an
nounced she would welcome a recon
ciliation. :
July 28, last year, a ragged
stranger ended his life by leaping|
into a furnace at the Imperial Oil
company plant at Sarnia, Ontaria.
Before the body could be recovered
it had been all but cremated. Mrs,
Lebert went to Sarnia, viewed the
body and identified it as that of her
husband. _ ‘
A coroner’s jury then reached the
conclusion the dead man was Le--
bert and Adelaide Lebert according—}
ly was recorded as dead. Mrs, Lebert
had obtained a divorce on the
grounds of desertion, several months
after his disappearance but she had
kept up the payments onhis $lO,OOO
life insurance. The coroner’s ver
dict expedited collection of the $lO,-
300 which last autumn she invested
in an apartment house here. The
apartment has provided her with a
good income gince then.
After buying the apartment, Mrs.
Lebert was married to William Man
ley, a 75-year-old Civil Wiar veteran,
Mrs. Leber is about 50 years old.
Whether the insurance compainy
can claim damages from Mrs. Man--
ley in view of the fact that Lebert
was declared by a coroer’s jury to
be dead, is a question .of law that
‘ must be investigated before any fur
~ ther steps are taken.
