Bubmitting a proposed amendment
to the Constitution of Georgia, to be
voted on at the General Election to
be held on Tuesday, Novembor 2,
1026, sald amendment to authorize
Crisp county to increase public debt,

WHEREAS, the Geneval Assembly
at its cesslon in 10256 proposed an
amendment to the Constitution of this
State a 8 set forth in an Aot apvroved
August 14, 19206,

equipping and operating dams and

eration of water power and electric
current; and for acquiring rights
of-way for power transmission lines,
and the building, equipping, and oper
ating of power transmission lines and
giations, with the right of condemna
tion for acquiring said sites, locations,
and rights-of-way, and for the purpose
of selling, for any aind all purposes,
water power and electric current;
and to provide how the power confer
red by this amendment shall be ex
ercised and for other purposes.
Section I.—Be it enacted by the
General Assembly of the State of
Georgla, and it is hereby enacted by
authority of the same, that article 7,
gection 7, paragraph 1, of the Consti
tution of Georgia as heretofore
amended, shall be further amended,
by adding at the end thercof a new
sub-paragraph in the following wnrd:z,‘
to-wit: “And except that the county
of Crisp may Tncur a bonded incent- |
edness in addition to debts hereinbe
fore in this paragraph allowed t> be
fncurred, to the amount in the agzre- |
gate mot to exceed the sum of ono
million two hundred and filty thou- |
gand dollars ard at a rate of interest ’

and/or without Crisp county, includ- |

and for the purpose of ac- ‘
quiring rights-of-way for pow- |
er transmission lines; and for
the purpose of improving, building,
constructing, equipping, mnmtalnlm_',l
leasing or operating the necessary |
power dams, ponds, plants, machin- |
ery, transmission lines and distribu- |
tlon stations, including all necessary
machinery and apparatus for the
manufacture, generation, tranamis
sion, sal, and distribution of water
power and electric current. The right |
of eminent domain {8 conferred upon |
said county of Crisp for the purpose
of acquiring such sites, locations,
overflow lands and rights-of-way nec- |
essary for the proper exercise of the '
rights <onferred by this amendment.
Said county of Crisp is fully author- i
fzed hereby to engage in the manu- l
facture, generation and sale of water
power and electric current for pm‘-t
poses of promoting the agricultural,
{ndustrial and clvic interests of said l
ocounty and for any and all other pur
poscs and to make all necessary con- |
tracts relating to the sale and dispo- ;
sition thereof, including tlhe right to'
fix the rate or rates to be charged
for all water power and electric cur- !
rent used for lightiug, heating, power |
and other purposes In sald county,

thority shall be a first lien upon all
properties acquired, and all improve- |
ments made, and all plants and lines |
and stations constructed and machin- i
ery and apparatus purchased with |
proceeds thercof; and in the event of |
the sale of all or any portlon of sald |
properties the proceeds thereof shall
be used for tho purpose of payment
of sald bondod {ndetbedness. The

be paid by preferonce out of the not
receipts of the water power and elec- |
tric current used, sold or disposed of,
manufactureG and generated under
this authority, after the payment of
maintenance and operating expenses: |

for general county purposes, All
bonds issued pursuant to this amend
ment shall be and are declared to be
non-taxable for any and all purposes.
Any dam constructed rursuant to the
authority hereof shall be equipped
with passageways for the passage of
fish over the same, Sald passageways
to be approved by the Department of
Game and Fish,
| Provided, however, that any dam

sale by Crisp county or any of its

the words, “For Hydro-Electric Pow
'er Bonds,” and the ballot of those

' words: “Against Hydro-Electric Pow

'the result of all elections therefor
and if the result of any such election

Power Commissioners to be paid out

of said power plant or out of 'hei
general fund of said county and said
commission is authorized and em-'
powered to employ such agents, ser
vants and employees, and to make and
enter into such contracts as are rea
ronable and proper in the exercise of
the duties and powers herein con
ferred upon said commission, The‘
taxing authorities of said county of |
Crigp are hereby empowered and it |
rhall be their duty to provide by tax
ation for the payment of the princi
pal and interest of any bonds issued
Lereunder in the event the net prof
its derived from the use, sale and
disposition of water power and ele@-
tric current hereunder shall prove in

See. 2. Be it further enacted by the
authority aforesaid that when said
nmendment shall be agreed to by two
thirds vote of the members elected to
each louse, it shall be entered upon
the Journal of each House with the
“ayes” and “nays” thereon and pub
lished in one or more newspapers
in cach congressional district of this
astate for two montbs previous to the
time for holding the next general
election and shall at the next general
¢clection be submitted to the people
for ratification, All persons voting
at sajd election in favor of adopting
the said proposed amendment to the
Constitution shall have written or
printed on their ballots the words:
“For ratification of amendment to
Article 7, Section 7, Paragraph 1, of
the Constitution authorizing the
County of Crisp to increase its bond
ed debt for Hydro - Electric Power
purposes,” and all persons opposed to
the adoption of said amendment shall
have written or printed on their bal_
lots the words, “Against ratification
of amendment to Article 7, Section 7,
Paragraph 1 of the Constitution, au
thorizing the County of Crisp to in.
crease its bonded debt for Hydro-
Electrie Power purposes,” and if a ma
fority of the electors qualified to vote
for members of the General Assembly,
voting thereon, shall vote for ratifi
cation thereof when the results shal
