'SEVENTEEN FLORIDIANS AC
CUSED IN DEATH OF NEGRO

—(#)+—The. lynching 'of a negro at
Labelle last May, in‘c¢onnection with
which seventeen men were arrested
on coroner’s warrants, will be inves
tigated by the Lee“‘county grand
jury which convenes here tomorrow.
The negro, Henry Patterson, who
was accused™®f attacking a white
woman was-slain in daylight by a
mob which then hauled his body
through the main street of the town
in an automobile. The woman he was
accused of attacking had failed “to
identify him as her assailant, accord- |
ing to authorities. M
The seventeen men, inciuding some
of the town’s leading c_itizens} were

of counsel for the accused men. A
hearing on petitions for habeas cor
pus writs last June, at which eye wit
nesses to the lynching were heard,
resulted in the release of nine of the
accused men without bond and the
admittance of the others to bail in
the sum of $lO,OOO each.
Several witnesses have heen sum
moned to appear before the grand
jury, The inguiry is expectfed to re-l
quire two or three days at least. i

Ennis MecDonald, who ‘with his son,
Jim, was arrested on charge of mur
der in connection with the death of
Abe Musgrove, prominent land own
er has been ordered held without
bail pending action of the Baker
county grand jury. Jim McDonald did
not ask a preliminary hearing.
At his committment trial Ennis
McDonald declared that he had no
criminal connection with the death
of Abe Musgrove, who died a short
time after he is alleged .to have
been shot by Jim McDonald. .
Ennis McDonald didn’t have an at—‘
torney to represent him at the‘pre-l
liminary trial of the case, althoughi
the state was represented by S. B. I
Short, who intruq:u’ced several wit-‘
nesses to testify as to the defendant’s
alleged connectié’fif with' the case. !
The quarrel which resulted in}
Musgrove’s death grew out of differ-i
ences of opinion as to the division of |
¢rops, Ennis McDonald having op-|
crated one of Musgrove’s farms thi’sl
year. The two men are saidrto have
been engaged in a heatéd exchange
of words in the business district
of Newton, the county site of Baker,
when Jim McDonald, armed with a
shotgun appeared on the scene. Ac
cording to a statement made by Mus- |
grove a short time before he died!

Frank Stapleton, of Atlanta, who. was
advised of Wagoner's arrest has re
quested that he be held for further
investigation, though the nature of
charges ‘against Wagoner in that city
late rot known here.

were later surrendered to Frank
Stapleton, a son of the Americus man.

out warning. After he was wound
ed he shot at his alleged aszailant
‘twice, but both bullets went wild.
Jim McDonald claims that he did not
shoot until after Musgrove reached
for his revolver. He will enter a plea
of self defense.
