Levy did not contest the
findings as they relate to the
board’s action and agreed to
the order. He can still con
test the facts in civil, criminal
or another state licensing au
thority’s proceedings, ac
cording to the order.
“(Levy’s) conduct consti
tutes sufficient grounds for
the Board to exercise its dis
ciplinary authority and to
impose sanctions on Respon
dent’s license to practice
medicine,” the order reads.
Levy is prohibited from
practicing medicine in Geor
gia without further order
from the board.
When the Tribune &
Georgian called the number
listed for Levy’s home ad
dress, a woman answered
and said it was a wrong num
ber. Levy is connected with
an ongoing St. Marys Police
Department (SMPD) inves
tigation, though he has not
been charged.
A verbal request to SMPD
for the initial incident report
was denied Wednesday by
Lt. Shannon Brock, who said
that the information in the
document was potentially
damaging to Levy’s reputa
tion and that case law sup
ported withholding reports
of that nature.
The Georgia Supreme
Court has found in favor of
releasing such documents,
said David Hudson, an attor
ney for the Georgia Press
Association.

“Attempts have been made
to seal lawsuits because they
contain damaging allega
tions,” Hudson told the
Tribune & Georgian, citing
cases involving the former
owners of the Atlanta Fal
cons and a Catholic church
in Atlanta.
“Just because (the) infor
mation was sensitive and po
tentially embarrassing was
held to be no reason to deny
public access,” Hudson said.
“Likewise, there is no excep
tion in the Open Records
Act for denying access to in
cident reports because the
content is ‘highly sensitive.’”
Georgia open records law
requires law enforcement
agencies to release initial in
cident and arrest reports to
the public, even during open
investigations. The Tribune
& Georgian filed an open
records request with the city
late Wednesday and the city’s
attorney was still reviewing
the situation at press time
Thursday.
