Defeat Of Ohio Sunday Law Revision
Spurs New Enforcement Campaign
CINCINNATI, (NC) - Defeat
o,f a proposed amendment to
Ohio’s Sunday closing law has
spurred enforcement of the
law in Cincinnati and elsewhere
in the state.
In a statewide referendum
November 6 voters rejected a
proposed amendment to the
state constitution which would
have permitted the sale of
“milk, milk products, and any
food item or food product for
human or animal consumption.”
City Manager C. A. Harrell
of Cincinnati has ordered a
resumption of a drive against
Sunday law violators begun in
1959. The drive had bogge>
down because of criticism b
some local judges of confusio
in the present law and its ap
plication.
Municipal Judge
Shannon was the first to hand
down a conviction following de
feat of the proposed amend
ment. 'He fined a furniture deal
er $25 and costs and warned
that a second offense would
bring a jail sentence.
In Dayton, City Manager Her
bert Starick reported that he
plans to confer with law en
forcement groups about the Sun
day closing question. In other
communities action against vio
lators is either under way or
in the planning stage.
The present Ohio Law res
tricts Sunday business to sales
of items of “necessity and char
ity” without spelling out the
specific kinds of businesses that
may stay open. It also allows
persons who observe another
day than Sunday as their Sab
bath to engage in normal busi
ness operations on Sunday pro
vided they refrain from them
on their Sabbath.
Two cases involving manag
ers of milk stores accused of
violating the law are pending in
the State Supreme Court. The
court’s ruling in these cases
may affect current efforts to
revise the law.
The Catholic Welfare Con
ference, whose membership in
cludes officials of the six Cath
olic dioceses in the state, said
the proper approach to revision
of the Sunday law is through
