Public Safety can arrest for DUI
Do you believe that West Geor
gia College Public Safety officers
can not arrest you for drunk and
disorderly conduct? Do you believe
that Carroll County Police may not
follow your car onto campus in order
to perform a sobriety test? If you
have made these assumptions, you
have been wrong.
In accordance with Georgia law,
the consumption of alcohol on
campus is strictly forbidden by
persons under the age of 21. The
administrators of West Georgia have
written explicit guidelines in the
Student Handbook for the college
students to follow. For example, the
guidelines dictate that alcohol may
not be served, consumed nor dis
played on campus unless it is an
authorized social function where no
one under the age of 21 will be
present.
If a student is questioned by
Public Safety for drunk and disor
derly conduct the student may be
given a citation or jailed for public
drunkenness if found to be guilty of
drunk and disorderly conduct. Ac
cording to Public Safety Corporal
Rodney Carr, underage violators will
most likely be given a citation and
released.
The school defines disorderly
conduct in the Student Handbook as
any “ disorderly or obscene conduct
or breach of the peace on college
property or at any function spon
sored or supervised by the college or
any recognized college organiza
tion.”
However, the procedure for DUI
is not quite so easy. Once an officer
spots a car weaving over the center
line, not using their lights at night or
failing to dim bright lights, the offi-

cer will stop the car. The officer will
then approach the vehicle and ask
for the driver’s license and insur
ance card. As the alleged DUI of
fender searches for the items, the
officer will also ask the person other
questions in order to evaluate if the
person is drunk.
If the person is determined to be
drunk, then he is asked to step out of
the car to perform one or more of the
sobriety tests which both West
Georgia and Carroll County officers
are trained and authorized to do. If
the person fails the sobriety test, he
is read the Georgia implied consent
law at the scene and arrested. At the
jail the offender takes a breathalyzer
test. Under current Georgia law a
person over age 17 is intoxicated if
he registers over .08.
The offender is finger printed and
usually given two traffic violations
plus charged with DUI. In court an
offender receives a minimum S3BO
fine with 30 days in jail or probation
if the person agrees to attend a DUI
driver’s school.
If the offender is caught for drunk
and disorderly conduct or DUI on
campus, the person will also be
subject to school disciplinary pro
cedures. First, a written summary of
all complaints against the offender
will be submitted to the Office of
Student Services. Next, the student
will be notified in writing of the
charges, and the student is asked to
to a conference where he or she is
asked to plead guilty or not guilty.

Commission, a hearing before a col
lege official or waiver of a hearing.
Then, the Student Judiciary
Commision will submit their recom
mendations to the Vice President for
Student Services. Finally, the of
fender is notified by writing of final
decisions.
West Georgia officers have a
jurisdiction of 500 yards around
campus which means Public Safety
officers are able to make arrests and
incarcerate individuals in the Carroll
County jail while in this 500 yard
jurisdiction. Landmarks which Pub
lic Safety uses to judge this jurisdic
tion are the Krystal on Maple Street,
South Ridge Apartments on Burson
Avenue, and River’s Edge Apart
ments on Columbia Drive. West
Georgia College also lies under
Carroll County’s jurisdiction; there
fore, the Carroll County police offic
ers may make arrests or other offi
cial duties on campus. Also, Public
Safety officers may, while in a high
speed chase, pursue the individual
outside the 500 yard jurisdiction and
make an arrest.

replies to letter

Dear Editor:
I am writing to you in response
to the letter from Kathryn E. Jones
in last week’s edition.
When I was elected SGA
president in spring, I was elected
to serve and represent the student
body. My door has always been
open to anyone with any sugges
tions, problems, complaints, and
criticisms. If Miss Jones had
wanted any action from my office
or from me personally she will
find that a better way of going
about it would have been to drop
by and see me. Instead of ex
pecting me to be a mind reader
respective to her concerns.
Perhaps a more direct approach
on Miss Jones’ part would work
better next time.
Incidentally my loyalties lie
with the student body; just come
to our meetings and find out.

could be realistic
Dear Editor:
Many articles have recently been
written about Public Safety.
While checking the parking lots
for unauthorized vehicles is good,
some of the parking laws are a little
picky. For example, I do not un
derstand why a car cannot be parked
backwards in a parking spot. What
does it matter as lon as it is only
taking up one spot? I also do not
understand the harm in a car being
parked one or two inches over the
line.
While most of Public Safety’s
parking laws are good, I feel that
some of their silly laws should be
overlooked.
