STILL IN FORMATION STAGE
Reports On Nonpublic
School Fed. ‘Premature’

Reports that all major
groups conducting nonpublic
schools have established the
first Council for American
Private Education have been
called “premature” by
nonpublic school officials,
who say they are still in the
process of forming it.
Cary Potter, president of
the National Association of
Independent Schools and
previously identified as acting
chairman of the private
education council, told NC
News he is actually chairman
of an 11-member steering
committee which is finalizing
details for such an
orgainzation, which will be
the first of its kind.
Even the name of the
council is not yet definite,
Potter said.
Steering committee
members meeting early in
July in Boston passed a
resolution saying they would
“cooperate in the formation
of a nonprofit corporation”
which would promote
communication and
cooperation among nonpublic
elementary and secondary
school organizations, their
public school counterparts
and the various branches and
agencies of the federal
government. The corporation
will also “further the well

theologian, has defended the
notion of a fundamental law
of the Church, which sets
down the theological and
juridical principles governing
the Church.
But he conceded that the
present proposed text of such
a law is inadequate. The
controversial text-known as
the “Lex Fundamentalis”--
-has been widely criticized by
other churchmen.
In an article appearing in
the Paris daily Le Monde,
Cardinal Danielou said:
“Law, in fact, is a
constitutive element of the
Christian mystery. Law is
first of all the expression of
the divine will. It describes
the objective plan of God for
man. It gives the very
meaning of existence.”
This divine law, the
cardinal said, at every stage of
man’s history, has to be set
forth in detailed form, which
constitutes the charter of the
people of God. The first two
commandments of the law of
the Gospel, love of God and
love of neighbor, are defined,
he said, in prescriptions that
govern the life of the
Christian community.
“Thus it is,” Cardinal
Danielou said, “that the life
of the Church is governed by
a certain number of laws
concerning its various
aspects . . . .The
establishment of these laws
depends on the governing
power that Christ confided to
the Apostles and their
successors. Already, in the
New Testament, we see Saint
Paul set forth rules
concerning the holding of
assemblies, the discipline of
marriage, the choice of
ministers, and impose
sanctions on those who
violated these rules.
“It is through the entirety
of these prescriptions that the
spirit of the Gospel can pass
into the concrete reality of
the individual and collective
life of the Church. It is clear
that their sole purpose is to
permit this spirit to be
realized„„That means that
(legislation) must not be
taken for an end in itself, and
that it must always be
referred to the spirit. That
being of education in general
and of their constituencies in
particular,” committee
members said.
“There is no organization
yet,” said Dr. Walter Howe,
associate secretary of the
General Conference of
Seventh Day Adventists.
“Each of the groups are
taking (a proposed charter) to
their official bodies to see
what they will do with it.”
The Seventh Day Adventist
official said he is a steering
committee member, though
no one from his group had
attended the Boston meeting.
Steering committee
members meeting there were
also attending the annual
conference of the Education
Commission of the States-a
group of political and school
leaders whose goal is
educational improvement on
a national scale. The next
steering committee meeting is
planned for November.
Most committee members
contacted recently by NC
News were enthusiastic about
the prospective nonpublic
federation. Most also stressed
that its primary thrust would
not be trying to get public
financial assistance for their
schools.
“Such an organization will
indeed be historic and
perform a significant function
means it can be challenged
when it does not realize its
goal or wanders from it. That
means also that it must be
revised in view of new
situations.
“But it remains true that
the Church, like every
society, cannot exist without
an assembly of laws.”
Cardinal Danielou said the
law is the instrument of
liberation from the servitudes
that impede the action of the
Spirit in man, and to reject
the law is to bind oneself in
slavery.
The confusion of authentic
evangelical liberty, “which is
mastery of the instincts and
obedience to God,” with
challenging of the moral law
and slavery to instincts is
nothing new, the cardinal
said. “And at a time when the
drama of the West is the
powerlessness of liberty to
discipline itself, it is contrary
to the Gospel that Christians
should become in the Church
accomplices of moral anarchy
and institutional subversion,”
he said.
Cardinal Danielou said the
Second Vatican Council did
not intend to reject all laws.
“The council denounced
abuses, real abuses,” he said.
“But to denounce abuses is
the contrary of calling into
question the realities that are
prior to these abuses. It is on
the contrary to restore them
in their authenticity. To
denounce legalism is to give
the law its true meaning. To
denounce clericalism is to
rediscover the essence of the
ministry. To denounce
triumphalism is to defend
reality against appearances.”
The cardinal said that some
today are using the council to
attack what the council
sought to restore. They are
no longer den ouncing
triumphalism, but the
certitude of the faith, he said.
“Law without liberty is
oppression; but liberty
without law is despair,”
Cardinal Danielou said. He
said the Christian is called to
collaborate in realizing the
design of God. “It is in his
complete adherence to the
will of the Father that Christ
showed the meaning of
liberty,” he concluded.

Edward R. D’Alessio, director
of the U.S. Catholic
Conference elementary and
secondary education division.
He predicted that the
organization “should be
functional” by Jan. 1, 1972,
but said discussions to date
have only been exploratory.
“Formation of the Council
for American Private
Education is simply a matter
of survival for that essential
element of the national scene
that is private education,”
said Father C. Albert Koob,
president of the National
Catholic Educational
Association.
“This should not be
misconstrued to infer a panic
button attempt to solve
economic problems with a
united push for governmental
funds,” the Norbertine priest
continued. “More important
is the fact that the council
would provide a- framework
for communication and
cooperation between various
groups of private elementary
and secondary schools and
between these schools and
their public school
counterparts.”
“It has been our position
for at least seven years that
we will not push for public
funds,” said Dr. John
Blanchard, executive director
of the National Association
of Christian schools. That
group represents 270
interdenominational
Protestant schools in 40
states.
“We have never said that
we will not take public
funds,” Dr. Blanchard
continued, “but the whole
business of accepting them
depends on the way the
package is wrapped, as far as
restrictions, qualifications,
etc. So far, we have not seen
a legislative package we
would accept.”
“I strongly hope,” he
concluded, “that the
priorities of the group will be
to the philosophical
uniqueness of private schools
and parental responsibility
for education.”
Although public aid “is
undoubtedly a question we
will pursue at some time,”
steering committee chairman
Potter said, that would not be
the main concern. He said he
hoped such a federation
would be able to provide the
public with statistics and
other data on many different
aspects of nonpublic
education.
“I don’t think they (the
public) know anything much
about variety and kinds (of
nonpublic schools),” Potter
said. “The question is often
discussed strictly in terms of
Catholic schools.”
Approximately 85 percent
of the nation’s nonpublic
schools are Catholic.
“It’s not the ‘gimmes’ that
motivate us,” said Rabbi
Bernard Goldenberg, director
of school organization and
professional services with the
National Society for Hebrew
Day Schools.
The rabbi said those
interested in forming a
nonpublic federation “think
private education has always
been part and parcel of the
American educational
system” and should have “a
voice to speak up for itself
and highlight its contribution
to American society.”
He said he hoped such a
federation would apply
public relations techniques,
seminars and workshops to
“energize people in private
education in various states to
get together,” and promote
greater cooperation between
the public and private sectors.
“There is no one right now
who really does this,” Robbi
Goldenberg added.
“Sometimes (public and
private education) may
appear foolishly as warring
camps.”

Challenge Critics
Of Basic ‘Law’
VATICAN CITY (NC) -
An editorial in L’Osservatore
Romano has challenged
critics who view the
much-debated proposed basic
law of the Church and the
way it is being handled as a
form of Roman imposition.
The unsigned, front-page
editorial appeared in the July
28 edition of the Vatican
City newspaper following a
spate of critical comments of
the s o-called “Lex
Fundamentalis,” in both
American and European
circles. Among criticisms
leveled at the proposed basic
law was an interview granted
to NC NEWS by Cardinal Leo
Suenens of Brussels-Malines,
Belgium.
The editorial, while not
singling out any specific
article or interview, argued
that the recent criticism has
not taken into account
sufficiently the clarifications
given by an official of the
Commission for the Revision
of the Code of Canon Law at
a Vatican press conference
July 5.
The writer expressed
astonishment that the'
clarifications have not been
“taken into consideration~or
only insufficiently in the
comments of the past few
days.” “When they are
mentioned, it is only in order
to insinuate that the
clarifications are inspired by a
healthy rethinking as a result
of previous controversies,” he
said.
The editorial particularly
took issue with the claim that
the world’s bishops have been
required to express their
opinions on the document by
Sept. 1 and that it will then
be submitted for the approval
of the World Synod of
Bishops which opens in Rome
on Sept. 30. The writer
repeats the statements made
at the July 5 press conference
that this is not the case at all
and it will take several years
of consultation and study
before such a document
could be ready in its final
form.
Referring to the request of
Cardinal Pericle Felici, head
of the canon law commission,
that the world’s bishops
express their feelings on the
presen t draft of the
document, the editorial
stated:
“It is important to note
that this very broad
consultation of the
bishops-who are asked, above
all, for their opinion of
whether or not the Lex is
advisable-is in keeping with
the spirit of cooperation
promoted by the Second
Vatican Council and favored
in this case, right from the
early phase, by the initiative
of the Pope to whom, clearly,
the promotion of any
collegial action of the body
of bishops belongs.
“Therefore, what is being
affirmed regarding ‘Roman
impositions’ has no
foundation in truth and it is
surprising to read about
insinuations of this kind and
to see them spread and
published in the face of
facts.”

Fathers Berrigan
Denied
WASHINGTON (NC) -
The U.S. Board of Parole has
refused to parole Fathers
Daniel and Philip Berrigan,
imprisoned in Danbury,
Conn., for the destruction of
Selective Service records.
If parole had been granted,
Jesuit Father Daniel Berrigan
would have been released
Aug. 2; his brother, Josephite
Father Philip Berrigan Sept.
14.
Parole
The seven-member parole
board voted, however, to
require Father Daniel
Berrigan to serve out his full
term, making his mandatory
release date - with time off
for good behavior - Nov. 23,
1972.
They agreed to a second
parole hearing in a year and a
half for Father Philip
Berrigan, whose mandatory
release is not until Feb. 15,
1974.
