Smith, “Commanding General of the Khaki Shirts of America," had threatened to “kill all the Jews in the United States" unless his bodyguard, Samuel Z. Wein, a Philadelphia Jew, helped to railroad Athoa Terzani, an anti-Fascist, for the murder of Antonio Fierro, another anti- Fascist, during a Khaki Shirt meeting last July. Wein turned State's evidence at Terzani* trial and his testimony was largely instrumental in the acquittal of the young anti-Fascist. Wein, a former “major-general" of the Khaki Shirts, who had previously told the grand jury that I'erzani had fired the fatal shot, admitted at the trial that he had lied because of Smith's threat. Then he told the court that the actual slayer was a man by the name of Frank Moffer. Wein’s testimony revealed that he had become conscience-stricken last August and confided in Leon Melzer, president of the Philadelphia branch of the American Jewish Congress, who put him in touch with the Terzani defense committee, which was headed by Arthur Garfield Hays.
