WASHINGTON. (JTA > — The
: decision of the European Com-
i mand to commute the life sen
tence of Use Koch to four years
is considered final by the Army
j Department and cannot now be
, increased, Secretary of the Army
! Kenneth C. Itoyall said in a letter
I to Senator Raymond Baldwin of
Connecticut recently. Frau Koch
j was convicted of charges of tor
turing prisoners at the Buchen-
1 aid death camp, being respon
sible for the death of many and
: of having some executed in order
I to obtain human skins for lamp-
! shades, boos covers and other ob-
I jeets.
I
Senators Baldwin, Charles W.
I Tobey of New Hampshire, Lever-
i ett Saltonstall of Massachusetts,
! and Congressman Emanuel Ceiler
of New York, wrote Secretary
Royal! asking him to explain why
General Lucius D. Clay, Com-
mandin gGeneral of the European
Command had signed the commu
tation order. Royal 1 also told the
members of Congress that while
he had not personally seen the
record in the Koch and 12 similar
cases, he was "convinced that all
of the convictions and sentences
therein were carefully considered
by the European Coir.mand and
that the result represents their
best judgment—a judgment which
in other matters 1 have found ex
ceedingly sound, and certainly not I
erring on the side of softness to- i
ward German criminals."
Meanwhile, the possibility of a i
Congressional investigation of the
commutation mounted here as the
wave of protest against the ease
ment of sentence by Gen. Clay
grew in intensity. Sen. Homer
Eerguson of Michigan, chairman

of tne Senate Investigations Sub
committee, stated that there was
a definite possibility of a "Sena
torial investigation if the Army
does not provide a satisfactory
explanation of the action."
The Army released a message
from Gen. Clay explaining the
reasons for the communtation.
The reason for the reduction of
sentence — under which Frau
Koch will be free in October, 1949
be said, was because "evidence
of her participation” in the atro
cities and murders commit teed at
Buchenwaid, which was once
commanded by her late husband,
1 d not warrant so severe a pun
ishment. “There is no convincing
evidence that she selected in
mates lor extermination in order
to secure tattooed skin or that
die possessed any articles made
of human skin,” Gen. Clay added.
Among the new protests are
those of Gen- Emil C. Ked, com
mandant of Scott Field, who
was president of the eight-man
military court which originally
sentenced Frau Koch. Gen Kiel,
who said he was “surprised” and
“rather shocked" at the commuta
tion, revealed that Col. Edward
Walker, another member of the
court, felt the same way.
Lt. Col. Othmar Eichmann, for
mer chief of the Evidence and In
vestigation Center of the U. 8.
War-Crimes Commission, who
collected and translated the evi
dence against Use Koch, said he
was “speechless” with amaze
ment at the action. William D.
Denson and Robert Kunzig, chief
and deputy chief prosecutor, re
spectively, at the Koch trial, have
protested the communtation as a
"travesty on justice.”
In an article written for the
overseas News Agency Denson
takes issue with the European
Command’s statement that there
is no reason to believe that she
selected prisoners for execution
in order to obtain their tattooed
skins or that she did not have any
objects made of human skin in
her possession. Denson said that a
lampshade, a brief case and a pair
of gloves made of human skin
were found in he,- room and a
witness testified to seeing a book
cove 1 ' in her possession that was I
made of the tattooed skin of a
prisoner who vanished shortly I
after she carefully noted down his i
number.
