GEORGIA, FULTON COUNTY
To The Suprlor Court of Fulton
County:
The petition of Franklin J. Hoffman,
Ernest T. Harmsen and Lawrence A.
Nelaon respectfully shows to the
Court:
1.
Petitioners desire to he Incorporated
and made a body corporate under the
laws of this State under the name and
style of
"EMMANUEL CHURCH SCHOOL
COUP."
for a period of thirty-five (38) years,
with full right of renewnl as may be
provided by law, with Its principal
office at such place In Fulton County,
Georgia, as Its trustees may from time
to time determine.
2.
The object and purpose of said cor
poration Is the desire to he chartered
ns on educational Institution and not
for pecuniary gain, for the establish
ment, maintenance and support of a
church school to teach any and all
subjects within the tenets of the
Luthernn faith, and to acquire and ad
minister funds and property which, af
ter the payment of necessary expenses,
shall be devoted exclusively to the
cause of charity, education and re
ligion.
3.
Said corporation Is not organized
and shall not be operated for pecuni
ary gain or profit und It shall have
no capital stock.
4.
No part of the property of Said cor
poration and no part of Its net earn
ings shall ever at any time Inure to
the benefit of any private shareholder
or Individual, nor shall said corpora
tion have the power to, and shall
never, carry on propaganda or other
wise attempt to Influence legislation.
8.
The corporation shall have the power
and authority to accept gifts and con
tributions, whether made by will or
otherwise, In any form of property,
provided that the objects specified by
the testator or donor are within the
objects and purposes of the corpora
tion.

The governing body of the corpora
tion shall consist of not less than
three (3) nor more than seven (7) mem
bers, which shall be designated the
Hoard of Trustees. The Incorporators
shall be the first members of the
Hoard of Trustees. Each of the mem
bers of the Hoard shall serve 1 for a
term of five (5) years hut may resign
at any time. Upon the death or resig
nation of any member of the Hoard,
a majority of the remaining Trustees
shall choose his successor. Should a
member of the Hoard of Trustees be
come disabled or for any cause or
reason cense to function and the same
continue for a period exceeding twelve
(12) months, then the 1 remaining mem
bers of the Hoard shall have the power
to declare the office vacant and elect
a successor trustee In the manner pro
vided above.
7.
The Hoard of Trustees, by majority
vote, shall have the power to adopt
all rules and regulations and by-laws
consistent with the charter and the
conduct nnd affairs and activities of
the corporation.
8.
The officers of the corporation shall
be a Chairman of the Hoard of Trus
tees, a Vice-Chairman, a Secretary and
a Treasurer; the latter two offices
may be held by one person. The
Trustees may appoint such committees
nnd agents and create such other of
fices as they shall deem best, and del
egate to them such powers and duties
as In the discretion of the Trustees
may seem appropriate.
9.
The corporation, upon the vote of a
mnjortty of Its trustees at the time
then In office, shall have the power
to do nnd perform any and all the
powers conferred by this charter, or
the laws of the State of Georgia, and
shall likewise have all other powers,
privileges nnd Immunities which, under
the laws of the State of Georgia, now
or hereafter may be vested in similar
corporations, Including, but not being
confined to, the powers enumerated
In Sections 22-1827 and 22-1828, Georgia
Code Annotated, as they may be ap
plicable to this corporation.
10.
The names and Post Office addresses

Your petitioners herewith exhibit a
certificate of the Secretary of the
State of Georgia as required by Sec
tion 22-1803. Georgia Code Annotated.

Your petitioners desire that they
may in- Incorporated under the Cor
poration Act of 1938. as amended by
the Acts of 1949, p. 953.
13.
They desire to obtain property, both
real and personal, by any lawful
means, to hold, use and enjoy the
same; and to be allowed to sell, ex
change, mortgage, lease or In any other
way deal with the same as may be
come desirable In the conduct of the
purpose of the Incorporation of the
Institution.
WHEREFORE, petitioners pray that
they may bo Incorporated under the
name nnd style aforesaid, with all the
rights, privileges and Immunities here
inbefore set out, and such other
rights, privileges and Immunities as
are or may hereafter be conferred
upon corporations of like character
under the laws of Georgia.

LONDON, (JTA) — Polish
Premier Josef Cyrankiewicz made
it clear at a press conference in
Warsaw that the Polish Govern
ment will not permit mass emi
gration of Jews to Israel, although
it will permit Jews to leave the
country if they can prove that
they wish to emigrate to Israel
to join their families.
The views expressed by the
Polish Premier, are reported in
“Folkstimme,” a Jewish news
paper reaching here from War
saw. The paper quoted the Pre
mier as giving the following ans
wer to a question on the possi
bility of the emigration of Polish
Jews to Israel:
‘‘Where the case concerns fam
ily reasons, we make no difficul
ties in granting emigration per
mits. This can best be seen from
the individual permits granted.
However, we have no intention to
organize mass emigration. This
could, among other things, be
given false political interpreta
tion. Justified applications are be
ing given positive consideration.”
“Folkstimme,” the only Jewish
newspaper in Poland, carries no
positive news from Israel. On the
other hand it tells its readers
that there is tremendous spcula-
tion in Israel and that the au
thorities there are not punishing
the banks or other financial in
stitutions for charging high in
terest rates on loans.
A message of thanks to Israel
—in the Hebrew language—was
printed in behalf of the Jews in
Poland by Warsaw Chief Rabbi
Morenu. The message was sent
in acknowledgment of a shipment
of ethrogim received in Warsaw
to enable religious Jews
in Poland to observe the Sukkoth
ceremonies. The shipment was
part of a load of ethrogim sent
by Israel to Jewish communities
in countries behind the Iron
Curtain.
In his message, the Chief Rab
bi of Warsaw expresses his good
wishes ‘‘for the building of Zion
and the in-gathering of the ex
iles.” He emphasizes that he
speaks in the name of the Rabin-
nical Council of Poland and the
Jewish communities there.
“Folkstimme" carries reports
from the Soviet Union revealing
that there is a great hunger
among the Jews there for Jewish
performances and concerts and
that this can be seen from the
success which a group of Jewish
actors from Vilna are enjoying
in many cities which they are cur
rently touring.
Enumerating the Russian cities
in which the Vilna troupe gave its
performances, the paper reports:
“Everywhere the concerts met
with tremendous success. The
audiences warmly received the
performers and simply did not
permit them to leave the stage
by applauding them heartily. In

NEW YORK, (JTA) — Dr.
Abraham Katsh, chairman of the
Department of Hebrew Culture
and Education at New York Uni
versity, has presented the NYU
a very old Torah he obtained this
summer from the Oriental In
stitute of the Academy of Science
in Leningrad. During a tour of
the Soviet Union Prof. Katsh also
brought back 72 Hebrew manu
scripts and a microfilm of what
is believed to be the oldest Bible
in existence.

As "Testament of Reality ”
NEW YORK, (JTA) Critical
comment on the current German
performances of “The Diary of
Anne Frank” — based on the true
diary of a young Jewish girl who
later lost her life in the general
holocaust caused by the Nazis in
World War II continued this
week to stress the theme of the
immediacy of the play’s message
for present - day German audi
ences, it was reported in “Var
iety,” show business trade news
paper here.
The newspaper’s report from
Frankfurt, for example, quoted
the "Frankfurter Allegemcine,” as
saying, “This is no drama in the
old sense. It belongs to the
Passions of Christ, brought nearer
to us step by step." In its nearly
full-page review, the Frankfurt

On Program of JWB
Parley in Memphis
Samuel D. Gershovitz, execu
tive vice president of the National
Jewish Welfare Board, will fly
to Memphis to confer with dele
gates attending the 11th Annual
Conference to the Southern Sec-
tion-JWB on November 3-4.
For over twenty years, Sam
Gershovitz has devoted himself
to the services of the Jewish
Center movement and of its na
tional organization - the Jewish
Welfare Board. Except for a peri
od of five years, during which
he was an Executive Director of
the Jewish Community Centers
in Chicago, Mr. Gershovitz has
filled almost every professional
function in various departments
of the national organization. He
was one of the organizers of the
reconstituted United Service Or
ganizations (USO) in 1951 and
is a member of its Board of Di
rectors. The popular professional
leader of JWB also serves as a
Board Member of the National
Social Welfare Assembly, the
Commission on Hebrew Language
and Culture, National Council of
Boy Scouts of America, Executive
Council of the American Jewish
Historical Society and National
Committee on Foundations and
Trusts for Community Welfare.
The work of the Southern Sec
tion Conference will be devoted
to the subject: “Does the Jewish
Community Center Serve the
Total Community?”

of action. The matter was re
ferred to the Budget Committee,
which, in turn, authorized Di
rector of Finance John M. Pierce
to invesligate violations. Once
that report is in, legislative ac
tion — possibly at the legisla
ture’s next session — can be un
dertaken.
