The problem of suppression of
individual rights has perplexed the
nation Brandeis loved so well

wrong decisions by the representa
tions of others who are being af
fected ...”
‘‘We Americans are committed
not only to social justice in the
sense of avoiding things which
bring suffering and harm, like un
just distribution of wealth; but we
are committed primarily to demo
cracy. The social justice for which
we are striving is an incident of
our democracy, not the main end.
It is rather the result of democracy
—perhaps its finest expression—
but it rests upon democracy, which
implies the rule by the people . . .”

herself for equality of nationalities

Suppression of argument and
ideas was attacked by the Justice
who asserted: “It is the function
of speech to free men from the
bondage of irrational fears . . ."
“The frank expression of conflict
ing opinion lies the greatest prom
ise of wisdom in governmental act
ion; and in suppression lies ordi
narily the greatest peril ...”
"The constitutional right of free
speech has been declared to be the
same in peace and in war. In peace,
too, men may differ widely as to
what loyalty to our country de
mands; and an intolerant majority,
swayed by passion or by fear, may
be prone in the future, as it has
often been in the past, to stamp as
disloyal opinions with which it
disagrees. Convictions such as
these, beside abridging freedom of
speech, threaten freedom of thought
and of belief.”
