quence, the House permitted
Henry to retain his seat. The
dilemma was resolved by a re
markable constitutional inter
pretation which held that non-
Protestants, while constitution
ally denied executive or judi
cial office, did not violate the
state constitution by serving
as legislators. Non-Protestants
could make the laws; they
could not interpret or execute
them!
North Carolina continued to
withhold full rights from
Catholics until 1835 and from
Jews until 1868. In the mean-

time, however, Henry’s address
was invoked in 1818 and later
by the protagonists of Jewish
equality in Maryland. A few
years after its delivery, it was
published in The American
Orator, a widely-used child
ren’s reader which influenced
a generation — even in states
which maintained Jewish disa
bilities.

for continuing an established
Church, that is for the state to
subsidize Christianity. On the
opposite side was James Madi
son, who pointed out the injust
ice of taxing Jews for the sup
port of Christian churches or
Catholics for the support of
Protestant churches. Thomas
Jefferson was out of the coun
try during this debate and for
that reason it lasted longer
than it would, had he person
ally added the great weight of
his influence to Madison’s side.
In the end, however, the lib
eral American attitude won
and the Jews were given the
complete freedom and equality
which we take today for grant
ed.
