£XTe might criticize a jury
for condemning a person to
death on doubtful evidence, at
best highly circumstantial.
That the 12 men were terror
ized by a mob oa - carried away
by the passion and hate that
swept over Atlanta, while un
derstandable. is not justifica
tion for a miscarriage of
justice. A greater blame at
taches to the Georgia courts
which refused a new trial
demanded by the decent ele
ments in the state, by people
from all over the land and by
the Legislatures of Texas and
Tennessee.
Evidently there was doubt as
to the guilt of Frank in the
Georgia courts which heard
motions for a new trial. Yet the
appellate judges, including
Roan, allowed the conviction to
stand. In the U. S. Supreme
Court, though two great jus
tices. Oliver Wendell Holmes
and Charles Evans Hughes,
held that due process of law
was denied when the jury was
terrorized by a raging mob.
Frank's writ of error was dis
missed. But such is the law of
the Supreme Court today and
whenever the question is rais
ed the justices quote with ap
proval the dissenting opinions
of Holmes and Hughes in the
Frank case.
In his readable, jouranalistic
style, free from tongue in the
cheek clowning, Mr. Golden
writes a vivid, exciting account
of the Frank affair, its pusillan
imity and ochlocracy. Police
subornation and prosecution
shystering, newspaper sensa
tionalism and vicious demago
gy, lynching and blood lust
presents an appalling picture
of the depths to which mob
rule can reduce life in a
democracy. B u t fortunately
there is another side to this
gloomy prospectus.
It is heartening to read that
at this tense critical moment
a man of honor, a character, or
nobility, acted to prevent a
blot from staining the escut
cheon of his great state. The
Governor of Georgia, believing
in Leo Frank’s innocence,
commuted the hanging to a
life sentence. This fearless act
almost brought on the lynch
ing of popular John M. Slaton,
who had received the highest
vote of any Georgia governor
since the Civil War.
Tom Watson's monument
may stand prominently in front
of the State Capitol yet John
M. Slaton, who for conscience-
sake virtually became an' exile
for several years, remains the
outstanding heroic figure
among the Chief Executives in
the chivalrous h i s t o r y of
Georgia.
