Why is a Jewish divorce written
in Aramaic?
One reason is that since the issue
of marital relations is of such great
importance the divorce is written
in Aramaic to conform with the
original concerns and qualifica
tions of the procedure so as to
prevent any doubt as to the validity
of the divorce. Doubts cast on the
validity of the divorce document
could obviously have far reaching
and critical effects on the family
life and purity of the Jewish
people.
Some sources claim that the
Aramaic language was and is still
used to establish and continue a
most obvious clarification of the
act of divorce. There are some who
claim that Aramaic was used
because it was the popular
language of the period in which the
text of the divorce document
became established.
Why is it that a benediction b
not pronounced before the
proceeding of a Jewbh divorce just
at it is before the performance of
other commandments?
Several reasons are advanced
for this situation. One is that the
benediction is eliminated because
sometimes the divorce is written
due to the mbbehavior of one of
the spouses. Thus it may be less of
an accomplished mitzvah
(commandment), in some cases,
than a compulsory result of
misbehavior.
A second reason claims that
before writing the divorce one is
not sure that it will be fully
executed, since before it is duly
signed by witnesses and handed to
the woman something could
happen to either interrupt or
invalidate the procedure. Thus
writing the divorce b just the
beginning of a procedure that
takes several steps which might or
might not be completed.
As a matter of fact, one
authority states that the reason for
which the Jewish divorce
procedure is so technical and
exacting is that this would allow
the couple to change their minds as
to their wish to divorce at any step
during the procedure before the
technicalities of the divorce
procedure have been completed.
