Klinghoffer daughters irate
over verdict in hijack trial

WASHINGTON —Whether the
United States government will move
to locate and prosecute Abu Abbas,
the mastermind of the Achille Lauro
hijacking, appears to depend on
further results in the Italian courts
which may take years before com
pletion.
While expressing both satisfac
tion and disappointment with the
sentences meted out to the hijackers
affiliated with the Palestine Liber
ation Front, a branch of the Pales
tine Liberation Organization, the
State Department noted it would
not take legal action against them
because “under Italian law, the
legal process is not yet complete.”
“The defense or the prosecution
can file appeals, and it’s my under
standing that in Italy a successful
prosecution appeal can result in a
more severe sentence,” the depart
ment’s chief spokesman, Bernard
Kalb, said.
On the question of U.S. extradi
tion, Kalb said, “The U.S. govern
ment has reserved its legal right to
seek extradition of the hijackers
once all Italian legal proceedings,
including appeals, are ended.”
The department’s statement said:
“The Italians conducted a serious
investigation and trial. An inde
pendent judiciary made its deci
sion based on its evaluation of the
evidence. The U.S. is pleased that
persons reponsible for the death of
an American citizen (Leon Kling
hoffer) and injury and damages to
others have been convicted. We
hope these convictions will deter
terrorist acts in the future. We note
Abu Abbas got a maximum sent
ence under Italian law. We regret
that the murderer of Leon Kling
hoffer was not treated more se
verely.
The Palestine Liberation Organ
ization was jubilant about the re
sults of the trial in Genoa while
Klinghoffer’s two daughters were
outraged by the verdict. The PLO’s
spokesman, Ahmed Abdel Rahman,
in Tunis said, “The verdict proves
the PLO was not involved since
Abbas is a declared enemy of the
PLO’s leadership.”
Judge Lineo Monteverde, who
was on the eight-member jury and
announced the verdict, told repor
ters that the court believed Abbas
and two military officials of the
PLF staged the piracy on Oct. 7-9,
1983, to “weaken (Yassir) Arafat’s
leadership.”
This conflicts with a previous
PLO claim that Arafat had sen t
Abbas to the Achille Lauro to
avert bloodshed. Abbas at the time
of the hijacking was described as
Arafat’s closest PLO associate
Italian authorities, and later Yugo
slav officials, allowed Abbas to flee
from their countries after he had
been seized on the Achille Lauro
and brought to Italy.
Abbas and five followers were
convicted of the hijacking of the
Italian liner. Abbas and two PLF
miliary officials—Ozzudin Badrak-
kam and Ziad el Omar—were given
life sentences. The hijacker accused
of actually killing Klinghoffer,
Youssef Magied al-Moloi, recieved
30 years in prison. Five other de
fendants received prison terms
ranging upward from 15 years.
Four others, all tried in absentia,
were acquitted. Abbas and the two
PLF officials were among 10 tried
in absentia. Under Italian law,
parole for those convicted can be
considered only after they have
served half of their sentences.
“We are just outraged,” Lisa
Klinghoffer said on CBS Morning
News for herself and her sister Usa.
“Our father’s murderer is going to
serve a few years, and then he’ll be
out. We were hoping to hear that
they would receive life imprison
ment and that is not the case.
Those who were tried in absentia
recieved life imprisonment, but
those who were there, who actually
did the act, were not given that
penalty.”
Ilsa said, “The Italian judicial
system missed an opportunity to
send a clear message to terrorists
everywhere that we will no longer
tolerate these kinds of acts.”
