To the Honorable the Superior Court of said county,
HE petition of William Bryson and Harper
Bryson, respectfully shows, that heretofore, to
wit: oil the seventh day of M iy eighteen hundred
and thirty-two, that tho said Larkin Cleveland and
Thomas S. Tate, made, executed and delivered to
your petitioners, their certain deed of mortgage bear
ing date the day and year aforesaid, which is here in
Court ready to bo shown—which deed of mortgage
(among other things) conveyed to your petitioners
two lots in tho Town of Gainesville, Hall County,
Georgia, to wit: Lot number two in tho Town of
Gainesville, being the House and lot then occupied
by the said Thomas S. Tate, and lot number twenty,
eight in tho town of Gainesvillo, then occupied by
the said Thomas S. T >te, for a Gin-House lot, which
two town lots were mortgaged by tho said Larkin
Cleveland and Thomas 8. Tate, for the better s8cu.
ring to your petitioners the payment of a certain
promissory note uude and delivered to your petition,
ers (by tho name and style of VV. and II. Bryson) by
the said T-irkin Cleveland and Thomas S. l’ate, for
the sum of two thousand eight hundred and sixty-two
dollars and forty cents, dated on the seventh day of
May, eighteen hundred anil thirty two, and due ono
day after date, and which is here in Court shewn,
(and which was to bo paid to your petitioners on the
first day of March next thereafter, witli interest from
date.)
And your petitioners further show that the whole
amount of principal and interest on said note is now
duo and unpaid : Wherefore they pray, that unless
the said Lirkin and Thomas S. pay into the Clerk’s
office of this Court tha amount of tho principal, in.
tcrest and cost due thereon, within six months from
this date, the equity of redemption in and to tho
mortgaged premises thenceforth and forever !>e fore
closed.
« Therefore, on motion of counsel for plaintiff, it is
ordered by the Court, that tho said Larkin Cleveland
and Thomas S. Tate, pay into the Clerk’s office of
this Court, the amount of tfie principal and interest
now due .on said note, together with all legal cost,
on or *>eioro the expiration of six months, otherwise
tho equity of redemption in and t * tho mortgaged
premises be forever narred and forclosed, and that a
copy of this rule and petition ho published once a
month lor six months in some ono of tho public Ga-
