! to laws that arc plainly and palpably constitutional,
! or even cf doubtful character, she violates tho con-
[ stitution herself, tramples upon the rights of her co.
States, and is in open resistance to the laws of the
[Government of which she is a part. In such cases
the General Government has tho constitutional right,
j and will always have tho moral power, to enforce
obedience.
Analysis of Congressional Proceedings.—In the
Senate on Monday tho 16lh Dec. Mr. Van Buren,

In the Senate on the 18th, the Preaident’s annual
message was apportioned among the different com.
mitleos. Much of the sitting was devoted to mat
ters of local interest. Among other matters of im
portance, we notice the following resolutions submit,
ted by Mr. Clay :
Resolved, That the Secretary of the Treas
ury be directed to communicate to the Senate
a copy of the entire letter, addressed by Mr.
Crawford, when Secretary of the Treasury,
under date the 13th February, 1817, to the
President of the Mechanics’. Bunk of New
York, an extract from which is recited in his
Report of Congress of the 3d December, 18-
33 ; and copies of the other correspondence
of Mr. Crawford with thd Banks, about that
period, to passages in wluch the Secretary
alludes in the same report
Resolved, also, That the Secretary be direc
ted t« communicate to the Senate, a copy of
the corre.'jponderffce between the agent appoin
ted during the lust summer, to inquire upon
what terms the State' Batiks would undertake
to perform the services to the Government
which hud been performed by the Bank of the
United States, and the said Banks ; a copy
of the Report made, if one were made, by the
said agent to the Secretary, or the Executive;
the name of the agent, his compensation, and
in virtue of what law ho was appointed,
In the House, Mr. Binney, whom the Globo calls
the U. S. Bank Attorney, presented a memorial from
the President and Directors of said Bank, asking re.
dress for the violation of their charter by the removal
of the public deposites—which was referred to the
Committee of Ways and .Means. The following
resolution, which was introduced by Mr. Ewing, and
agreed to, is one of deep importance, and will no
doubt produce a lengthy and interesting debate :
Resolved, That the Committee of Ways and
Means be instructed to inquire into the expe
diency of authorizing a national currency of
835,000,000, to be founded upon the faith of
the United Slates, and be unconnected with,
and independent of all direct Executive con.
trol, except as may be required for the nomi
nation of Directors ; said currency to be
struck, perfected, and issued, in a department
of the mint of the United States, under regu
lations to secure an impartial distribution
thereof among the several States respective
ly, according to representative population, if
the same be required in virtue of the pligh
ted faith and resources of each State so re
quiring, to the United States for its redemp
tion, according to the legal stipulations on its
face, and the payment of such bonus to the
Treasury of the United States to defray ex
pense, and to guaranty ulterior responsibility,
as may be prescribed ; and said currency,
expediency of authorizing the application of a
part of the annual appropriation under the act
of 1824, for surveys, &c. to geological in-
vestigatious, and to the formation of a geolo
gical map of the United States.
On motion of Mr. Fillmore,
Resolved, That the Committee 'on Military
Affairs be instructed to iuquire into the expe
diency of so modifying the existing law in re
lation to the Militia of the several States, as
to permit each State, in time of peace, in the
discretion of its Legislature, to require no
person to bear arms under 21 or over 40
years of age ; and to permit the inspection of
arms to be taken by companies, instead of by
regiments or battalions ; and also, into the
propriety of providing arms and accoutre
ments at the public expense fox those liable
to bear arms ; and that they be required to
report to this House,' by bill or otherwise.
[Mr. F. subsequently, by unanimous consent,
changed the reference of the foregoing resolu
tion to a Select Committee, previously raised
on the subjects of a similar character.]
On Tuesday the 24th, little business was done in
either house. The Senate adjourned over to Thurs
day, and the House to Friday.
In tho Senate, .on Thursday the 26th, Mr. Clay
submitted the following resolutions, upon which he
made a speech which occupied the time until that
body adjourned over to Monday.
1. Resolved That, by dismissing the late
Secretary of the Treasury, because he would
not, contrary to his sense of his own duty, re
remove the money of the United States in de-
posite with the Bank of the United S. and its
Branches, in conformity with the President’s
opinion ; and by appointing his successor to
effect such removal, which has been done, the
President has assumed the exercise of a pow
er over the Treasury of the United States,
not granted to him by the Constitution and
laws, and dangerous to the liberties of the
people.

the expediency of so extending the provisions
of the act of Congress, passed 7th June, 18-

RAIL ROAD.
I N conformity with the act to incorporate the Geor-1
gia Rail Road Company, Books of Subscription |
for TWO THOUSAND FIVE HUNDRED Shares
of one hundred Dollars each, of the capital stock of
said company, will be opened at the office of William
L. Mitchell, Esq. in the town of Athens, on Monday
tho 3d day of February next.
The Books will be kept open for ten days, between
the hours of 9.in tho forenoon and 3 in the afternoon,
during which time the commissioners will receive
from individuals, corporations, or companies, sub
scriptions for so many shares as they may see fit to
subscribe for, not exceeding one hundred, until three
days shall have expired, and after that for any num
ber of the remaining shares they may think proper;
on the condition that at the time of subscribing there
shall be paid down to tho commissioners, or a majo
rity of them, five dollars on each share subscribed.
The remainder of each share may be called for in
instalments of not more than 15 dollars, in periods of
not less than six months; making, in all, not more
than ninety-five dollars on each share, in three years.
The company, under tho charter, have the exclu
sive right to construct and uso the said rail road,
and all other rail roads they may choose to make
within 20 miles pn either side of it, for thirty-six
yean; and to charge 50 cents freight per hundred
pounds, on produce and merchandize, and 10 cents
per cubic foot on articles of measurement carried 100
miles; and five cents per mile for passengers.
The stock of the company is exempted from taxa
tion for seven years from and after tho completion of
the said rail roads, or any one of them; and after
that, shall be subject to a tax not exceeding one half
per cent, on the net proceeds of their investments.
For a fell view of the rights and privileges grant
ed to the company, tho public are referred to tho
charter itself, as published in the Georgia Journal of
the 1st January inst. and the Banner of this date;
