•"a U G U S T A,
WEDNESDAY, April 16, 1800.
MR. DUANE, Editor of the Aurora
of Philadelphia, having been called to the
gar of the Senate of the United StaWs, in
consequence of a resolution charging him
with a breach of their priviledges, fearful
of committing himfelf from his ignorapce
of the forms of procedure in such cases,
and of the replies proper to make, reques
ted and obtained leave to be heard by
council, and wrote for assistance to Mr.
A. J. Dallas, and Mr. Thomas Cooper:
Both these gentlemen however declined to
appear before the senate for him—but whe
ther they deemed his cause too bad to be
advocated, or that an attempt to juftify the
publication of Malicious falfehood was
but aggravating instead of extenuating the
fault, we pretend not to fay—however
they took care in declining their assistance,
to express themselves in terms so indecent
and difrefpe&ful, as to evidence their in
tire approbation of a crime which admitted
not of j unification.
IN conlequence of receiving no aid
from his friends, Mr. Duane, refufed any
further attendance on the senate, and the
Sergeant at Arms, was dire&edto take him
into custody for the contempt, by a war
rant signed by the President of the Senate.
MR. DUANE and his friends now
complain loudly of ihe stretch cf power
in the senate, and of their unconftitutiona!
proceedingsto puniftihim, for what he calls
his manly and firm support of Republi
can principles, and his watchful guardian
ship of the rights of his fellow-citizens:—
But neither he, nor his friends have yet
condescended to inform us, on what parti
cular clause of the constitution, on what
moral principle, on what law human or
divine, a right can be claimed of publifli-
K ng malicious falfehoods against either, in-
Idividuals, or the government of our coun-
Itr}'. The Aurora has long been notorious
Ifor its lhameful publications—long been
■the fountain head of fcurrillity and abuse,
■against the government colleftively, and
lalmoft every individual concerned in its
ladminiftration. But when the Editor is
■called on only to efiabiijh his aflertions,
fcarely to prove the truth of his publications
I—then forfooth he expefls to find impuni-
P}’, by crying out opprcffion , and that public
ft Liberty is attached.
MISERABLE indeed would be our
Icountry, ‘ were its rights, its liberties, its
pappy government, in any degree depen-
Ber?t upon a vehicle of. public slander
Ppon a paper whose excess of violence has
■ofl it even the confidence of its early sup-
Porters. The Editor of the Aurora, has
■ong remained an evidence of the forbear
■ace of the government, and of the mo
■kration of the people, for the dignity of
■he one, and the sovereignty of the other,
■Uve been perpetually fubjetft to his abuse.
■'tit only has our Illustrious President been
■c'.ded with opprobrious epithets, but the
■ r ™ of defvgnmgfaftion has been applied
B°a majority of both houses of Congress,
Bud those proceedings have beenjndecent
■y censured, which have received the un
vocal approbation of a majority of the
■nerican people. Yet the author of this
Bkefe, this defamer of public and private
tells us, our liberties are endan-
Btted, because he is called to account for,
■'extenuate his iniquities—Our liberties
Bh as much in danger when the Burglari-
villain, the midnight affiaffin, or the
■ :c ked incendiary are called to answer for
■ e ’ r crimes at the bar of public justice.
■ :ie n a majority of our citizens can be so
■fpraved as to approbate the voice of Han
■'"when they delight to fee their rulers
■ \' e d to the malicious abuse of finifhed
■e r ** v ;ty—then indeed will our liberties
be insecure, and individual reputation and
public virtue will become equally infigni
ficant.
