TOPEKA. Kan. Jan. The su
preme court of the state of Kansas
decided today that the law passed
hy the legislature of this state, provid
ing for separate high schools for white
children and negroes in Kansas City,
Kan., is valid.
This decision paves the way for the
legislature, probably at its next ses
sion. to pass an act providing for
the separation of white children and
negroes in all the schools of the state.
The proposed change has been con
templated for some time, but n fight
has been waged bv the negroes on
It. which has stayed the change,
which undoubtedly would have been
made at the last session of the legis
lature. but for the fact that it was
deemed best to first make r test case
of the high schools, and. in the event
of success in the issue there raised,
to follow it later with a general bill.
BROWN SUIT POSTPONED.
ATLANTA. Ga.. Jan. 6.—(Special.) j
—The suit of Mary V'. Connally et al.
against Julius L. Brown and Joseph
M. Brown, as executors of the estate
of the late Joseph E. Brown, which
was set for trial next Monday, wao
Saturday morning postponed by Judge
John T. Pendleton on account of the
illness of Julius L. Brown until the
first Monday in March.
The suit was filed some months ago
liy Mrs. Connally and the other chil
dren of the late Senator Brown, and
made a number of very sensational
allegations as to the manner in which
the executors had handled the estate.
It was to have been tried next Mon-1
clay, but. on account of the sickness
of Julius L. Brown, one of the execu
tors. was postponed to the date above j
stated.
FIRE AT BLAKELY.
BLAKELY. Ga.. Jan. 6.—The main
building and seed house, with con
tents, of the Blakley Oil and Fertil
izer company, were destroyed by fire,
today.

The state department received a ca
ble today stating that former Presi
dent Morales, who has been a fugu
tlve for a couple of weeks, and who
was the leader of the rebellion
which proved unsuccessful has com
municated with the authorities his
willingness to resign the office which
| he held if he is allowed to leave the
country without being molested. The
i matter was given consideration and
iit is stated on good authority that
this agreement is satisfactory to the
defacto government and Morales has
been so notified. It is understood
that he will quietly leave at once, but
where he will go is not known.
TERRIFIC EXPLOSION.
Warming Dynamite Caused Loss of
Life.
CHICAGO, 111., Jau. (I.—Three men
were killed and seven injured by an
explosion today at a stone crushing
plant, at Corey, 111., about 20 miles
from Chicago.
According to the report, received
I here two employes of the company
were warming some dynamite prepar
atory to making a blast when it be
came ignited and exploded. Not on
ly the dynamite being warmed w»3
exploded, but that caused the explo
sion of a large quantity lying near
doing considerable damage. The force
of the explosion was felt 20 miles
from the scene of the accident.

Ras Saunders, a young man, has been
arrested and Is In jail for killing O.
W. Meadows, a prominent farmer and
merchant, who was found murdered,
his body being in his buggy. Jack and
Will Lawson, colored, are charged
with being accessories.
• Saunders admits that he did the
killing, lmt says it was accidental.
The evidence shows that Meadows
was killed, then put In his buggy and
carried on the road towards his home
for about one mile and the horse
1 turned loose to carry Meadows the
rest of the way home.

SAVANNAH. Ga., Jan. fi.—Col. J.
H. Kstlll will announce for governor
on January 15th. His announcement
has been prepared. It Is very short,
making not moro than twenty-five
newspaper lines.
Col. Kstlll said today that unless
something happened to make hint
change his mind very decidedly his
announcement would appear in the
papers on Monday morning, the 15th

SHOOTING FOLLOWED QUARREL.
CHARLOTTE, N. C„ Jan. (I.—Dr. E.
S. McDow today shot, and perhaps
fatally injured J. H. Witherspoon, a
! merchant at Lancaster, S. C., and also
J shpt W. M. Brown, a clerk in the
store. The shooting was the outcome
of a quarrel over a business trans
action. Dr. McDow is in jail. Two
pistols were found on his person
when arrested. It is said no weapon
was found on either Witherspoon or
i Brown.

FAIHMOUNT, Ga . Jan. 6 —(Spe
cial.) —Nicholas C. Warden was crush
ed to death; Frank Stroud was badly
Injured, snd four negroes painfully
hurt as the result of overturning a
car load of rails here this morning.
The accident happened on a siding
of the Ixmlavllle and Nashville rail
j road. The overturning of the car was
j due to the heavy load being placed on
| Its side while ihey were being thrown
| to the ground.
