Switchman Fell from Moving Train
and Sustained Injuries—Now Brings
a Suit Against the Railroad.
A damage suit was filed this morn
ing in the clerk’s office at the court
house, in which Columbus Callahan
is plaintiff, ar.d the Georgia Railroad
Co., defendant. The case is return
able to the city court
In the declaration of plaintiff it is
set out that Callahan, on February 4,
1906, was engaged m the duties of
switchman on the above road on that
part known as the Belt Line, and on
having received a signal from the en
gineer to come ahead, plaintiff start
ed toward the engine, walking over
the tops of the freight cars, and that
as llie tialu was running at 40 miles
an hour (so it is alleged 1 the train
parted, and plaintiff fell from rn«
carß. It Is set out in the petition for
damages that the road was at fault,
and that the Injuries to plaintiff are
worth the sum of $1,999. The case is
returnable at the April term of court.

Never has there been a greater di
versity of opinion regarding any book
than that long and widely expressed
In regard to Mrs. Humphrey Ward’s
remarkable book, and there has been
much of the same variety of verdicts
in regard to the play made front the
book. New York does not care for
dramatization, and so in spite of
Grace George's great popularity in
that city, the play was not a success
there. On the other hand, it has, on
the road, enjoyed an almost unpre
cedented triumph, a triumph the Au
gusta audience of last night feels
has been a thoroughly deserved one.
Unlike most dramatizations, the
piay is stronger than the book, and
it shows the erratic “Lady Kitty” to
be a more ldvable, and a far less ir
ritating personage than Mrs. Ward
has depicted her as being., It would
bo difficult to imagine Grace Georgs
as anything but lovable and beauti
ful, and all things desirable, but in
this instance the playwright is large
ly responsible for the new conception
partly because Kitty is made to seem
less blameworthy In contrast with a
certain harshness on the part of Ashe
that is not evident in the character In

climax. The play Is elaborately and i
artistically staged with a care for per
fection of detail and a regard for per- 1
feet proportions rather rare for a |
one-night stand. It is safe to say I
that never before in the history of tue
Grand has there been seen at the I
same time five such perfect stage pic- j
tures.
We had expected a great deal of
Miss George, and we found our expec
tations more than realized. First ann
foremost, she has performed that most
surprising of all theatrical nirracte.,
the presentation to an audience of
its ideal of a character previously
known in a book. As we said beforo
Margaret Mayo's "Lady Kitty” is in
finitely more to be pitied and admired
than is Mrs. Ward's "Lady Kitty,"
but Miss George’s “I-ad.v Kitty" is
physically and temperamentally the
woman we found so captivating, yet
so exasperating, in reading the book.
Last night, w e knew her to be per
fectly irresistible, and the wonder
grew that her husband or any other
man could ever be angry with so be
witching and so irresponsible a crea
ture. Miss Georges charm held the
audience spell-hound from the Itrv,
and at the close of her strong sc«r,4
in Venice —in which she arose *o un
expected heights in her art—she re
ceived a perfect ovation.
When we sav that the support is
in every respect worthy of the star,
we are, in this instanpe, saying a
great deal, but not one whit, more
than the truth. It would be difficult
to imagine a more evenly balanced
company. Mr. H. Reeves-Sraith as
"William Ashe," did his best work in
the third act, in which he indicated
in a manner positively masterly his
strong repression of almost over
whelming passion. His entire concep
tion of the role, as written for him
by the playwright, was a thoroughly
consistent one, and he failed to
measure up to the requirements of the
situation only in the last act, in which
act Miss George also was hardly ns
satisfactory as her work earlier in the
evening had led her audience to be
lieve she would be. Mr. Ben Webster
has a difficult part in that of “Geof
frey Cliff," and he skillfully makes
the most, of its strange demands. The
other men have little or no scope, but
help most pleasingly to round out the
Riuatlons. Ajnong the women, prob
ably the most attention-compelling
was Miss Katherine Stewart as “Lady
Parham,” but they ail played their
parts well, and wore their extremely
good clothes with distinction.
It Is to be sincerely hoped that Mr.
Brady will send Miss George to us
next, season, that, we may nave an op
portunity of judging her talent, in
some other part as pleasing as that
ot the unfortunate but fascinating
"Lady Kitty.” E. B. A.

R. W. Kilpatrick vs. Paul Heymann
and Jake Schrameck. executors of the
estate of Solomon Schrameck, is the
reading of a suit, filed today, return
able to the uperior court, April term.
It. is set. out in the petition that a
suit was brought against. Kilpatrick
for certain alleged money due a mule
and levy made, and that when the
case emne to trial a Judgment waH ren
dered in favor of Jhe mule owner, but
|he could not collect nor get his mule
because the mule had been killed. It
had broken ita leg and been killed as
a humanitarian measure.

Mr. B. J. Christman, of Chicago,
general cashier of the Fruit Growers'
Express, Is In the city the guest, of
Mi. George W. Bosmau. Talking to
a reporter of the recent, freeze, Mr.
Christman said lie did not expect
much of a failing off In the fruit, crop,
as lie has Just, completed an extensive
tour through the peach section and
everything looks favorable for a good
crop. From recent reports received
from his agents In North Georgia, the
damage Is nothing like as bad as
first reported. Mr. Christman lias Ills
southern quarters at Atlanta. This
is his first visit to Augusta, and,
speaking of the climate here, he said
It. was the fluesi he ever saw and was
not surprised at the hotels being
crowded, and thought this was the
coming winter resort of the Houtli.
BROKE SLOT MACHINES

COLUMBIA, H. C.. March 27.—8 y a
robbery that, was daring In its bold
ness, the slot machines of the Colum
bia Vending Co., located 111 the main
corridor on the first, floor of the Her
Iceley building, wore rilled of all the
cash In their tills last night. Both
the cigar ami chewing gum machines
were partially demolished and the
amount of cash taken was about $7.50.
That the amount of money taken was
small does not change the fact that,
the act was one of reckless audacity.
It was committed utter the electric
lights had been turned on and the hall
where the machines stood was bril
liantly lighted and the machines were
in full view of pedestrians on the
street and within arm's reach of all
peisons entering the building:
The person who committed the theft
smashed the cast Iron body of the
machines with some kind of weight,
and then forced the cash drawers out.

ants but. no other attempt has been
made to rob them.
There have been no arrests and
is no clue as to who the guilty par
ties are. A reward of $25 has been
offered by the company for their ar
rest.

ABOUT A ROAD

kins lias been petitioned for certiorari.
This case concerns the contention
over the closing of a road, the full
details of which were told of In The
Herald some months ago. The
lion will lake the ci.de, It granted,
to the superior court. To go back
a little Into the case. It may he said
that, a certain road—which Is a high
way in question as to being a public
or prlvato highway—was closed hy
defendant, and the plaintiff brought
suit to have the road o|u:ned by pro
cess of law. The case has been pena
tpg for sonio time.
BULLET IN HIS LEO.
A negro by tho mime of Mack Ross
was sent, to the Lamar Hospital this
morning hy Officer Htone. ltoss had
been Involved In a difficulty over In
Carolina, with the result that, he re
ceived a bullet In his leg. Ho was
not dangerously hurt.
