Far the Benefit of the Wounded
Soldier.

The following evidence will be re
quired in all militia cases, and in cases
of the regular army, where the discharge
and Certificate have been lost
or destroyed, or where they have never
been originally granted, to enable the
secretary of war to grant pensions, viz:
fn cases wherethe regular discharge'
and the surgeon’* certificate for disabili
ty cannot be bad, the applicant for a pen
sion, w’hether lie has been a soldier |n
the regular army, or a militiaman in tire
service of the United States, must pro
duce the sworn certificate of his captain
or other officer under whom he served,
stating distinctly the time and place of
his having been wounded, or otherwise 1
disabled, and that the same wounds of
disabilities arose while in>the service ot>
the United States, and in the line of his;
duty,, with the Affidavit of one or taorfc
smgeons or physicians, whether of the,
army or citizens, accurately describing
tire wound, and stating the degree oi dis
ability to. which the soldier may bceatP
tied under ft; these documents to be
y w orii to before a judge of the U. States ' 1
court, or some stale judge or justice of
the peach; and it a state jbdge or justice
of the'peace, then upder'the seal of the
clerk of the county in which such judge
or justk e may reside, ami in the same
of the paymaster who last paid the sol
dier as belonging to the service of the
United States, to be in every irtsfance*
furnished by the applicant, in order to
determine the date of the commence
ment of his pension.

All persons interested in obtaining
AVarrants for Military Bounty Lami,
due to the soldiers of the late army of
the United States, are requested to take
particular notice of the above caption,'
or title, in order to distinguish between
the information that issues from this of
fice, and the instructions given by the'
Commissioner of the General Land Of
fice attached to tire Treasury Depart
ment, from whence the Patents, or Defi
nitive Titles to the land here spoken of,
as well as of all oilier lands sold and ce
ded by the United States, must issue.
The present notice appears to be ne->
cessany, from errors that have frequent
ly occurred of late in the proceedings of
persona who have lost, o’- pretend to
have lost “an honorable discharge,” or
the evidence of a Military Land War
rant which Inis been issued.-upon such a_
discharge; ’
A special law was made by Congress
for the relief of persons who have bona
jl.de sustained such loss as was contem
plated by this law. The executive rules
and regulationsapplicab'e to it, were
.duly promulgated so ling ago as July,
181 G; of course,- according to the gene
r d tenor of all law's of tuat class, that
is, the execution of which is directed to
be according to “ such rulesnnd regula
tions ns the President pf the U. S.shall
in'scribe,” These i ules became a part of
the lefw and are only to be abrogated, or
altered, by the same line o authority
throughwhich they were first establish
ed; excepting,indeed, the sovereign au-.
thurity should interfere.
In several instances recently present
ed alibis office, individuals who,proba
bly may be -entitled to the benefit of the
law above cited, have errohe *usly con
founded their proceedings with those di
rected by a late ,regulation proceeding
from the general land office where blank
declarations reatty to be filled uy», have,
been distributed throughout the United
States for other laudable purposes; but
which are not calculated to serve in a
■compliance with the law relative ta lots,
warrants, and discharges: in the execu
tion of which it is not intended that any
inndtaition shall be sanctioned.

any military land warrants shall be lost
or destroyed, upon due proof thereof to
the satisfaction of the secretary of war,
a patent shall issue in thesame manner
as if the warrant was produced; and,,
when the same proof shall be pro
duced, that any soldier of the regular ar
my has lost his discharge and certificate
ol faithful service, *the secretary of war
ahull cause papers to be fornkhed such
soldier as will entitle him to his land
warrant and patent: To enable all per
sons comprehended by tire provisions -ol
the said act, to avail themselves of the
relief intended to Ire granted, the
secretary for the department of war
has directed that in case of milita
ry land warrants which have been lost
or destroyed, the parly shall, upon oath
m writing, state the time, place, and
manner of such loss or destruction, the
iate and number of the warrant, and tire

company and regiment (o which the tol
dier belonged, at the time of his dis
charge; aml alsq the state, county, and
township, in which he resides. Tire
oath must be made before an officer du
ly qualified to ad minister it, and the of
ficial characteramh signature of such of
ficer must be certified by the cierk of
the county, the mayor of the city, or by
such other officer as is required by the
laws and usages of the state where it is
made. Every application will be adver
tised one month iu the papers of the
state where the applicant resides, be
fore any decision will be made in the
case by the secretary of (he department.
Evidence in corroboration of.that of the
party will be required, wherq it is noi
satisfactorily shew n to be out of his pow -
er to produce it.
In the ca»e of lust discharges, the de
position, in addition to »he time, place,
and manner of the loss or destruction of
the discharge, must set forth the time
and place of enlistment, the company
and regiment to which the soldier be v
longed at tire time of his discharge, the
date of his discharge, and rank and nnine
of the officer who signed it:—it must ah
so state whether tire discharge contain
ed tf,ri eerlifleute of faithiful service re-,
quiretl by law, or the words “honorably
discharged,” or words of that import.—
The deposition of a disinterested wit
ness »s to the service and discharge of
the applicant, is required, in corroaora :

production roust be satisfactorily stated.
The testimony must be authenticated in
the manner [abcite] prescribed in the
icasu-of lost w.irrffrfta. Where the pre
cise dates or numbers cannot be stated.-
they may be stated to the best of the re
collection of the witnesses, whose credi
bility the magistrate who takes the evi
dence must certify in trie usual form.
