After my return, I got into peaceable possession ; John M'Wade being executor to the wiU of said' Foxwell, 1 swore 1 broth open the doors of the dwel ling hiiuse of said and took for cible possession, had me taken, and I was 1 confined sixteen days before I could call the attention of the Honorable Inferior <Jqurt; before them i proved I got into p ' peaceable possession, and was relieved by. that testimony from my confinement; Esquire M’Wade told several persons he would have me taken again; if he does, j my request is, that he may bp more par- I ticuW in nis next oath, for in the first, he was in or near Savannah at the time 1 took possession, and without his coming to see if I was in possession, swore 1 was, and that 1 broke lucks to do to (unless he came by night) and if by night he saw«me in possession; I know not how he swore what he has, for there never was a lock, , bolt or latch to the doors since 1 knew the house, and I do not believe there ever was since the building ot the house; the fayt is, Esquire M’Wade designs keeping the property until the law relieves him of that trouble/which 1 believe lie will be sorry for—l hope the clerk will be parti pulaain keeping M’Wade’s oatii until the sitlivg of the next Superior Court. RULE NISI UPON the petition of Roberts Thomas,' stating that he was possessed xis a certain bond given by one Henry Hughs in ifis life time to said Thomas, under the penalty of 5 hundred dollars, with a condi tion thereunder written, and to bo void of the said Henry Hughs, shall make and execute good end sufficient warranted ti tles to a certain tract of Land lying and being in the county of riurke, containing two hundred and fifty acres adjoining lauds of Hell and Walton, and bearing date on the 12lh day of December 1610, a true co py of said bond as nearly as can as recol lected by said Thomas is annexed to said petition and filed in the clerks office to gether with such other evidence as the said Thomas lias, and the said original be ing destroyed. It is not a little remarkable, perhaps, that an undertaking of this kind has been so long delayed, and that while, in many instances! our, dully newspapers have uUcmnted to blend literary articles of interest and merit with the dry detail and * confusion of political matter, no one should have thought of separating tlie two, and establishing a general repository for the reception* and circulation of useful and polite literature. As far as tl;e editor has the means of information, he is acquainted with no paper published south of Haiti more which hears the character ofthe one he has in contemplation ; and as Columbia is nearly the central situation between North Carolina and Georgia, this place nib races superior local advantages to ma ny others, and is particularly favorable to the wide distribution of such a paper thro* his and the neigboring states. In prosecuting this work it will be t|ia editor’s constant aim to furnish it with general matter only as may be of such utility, or interesting and important on ap count of the ability and merit which it ipay display.
