ing he was possessed of a note oi
hand made by Robert F. Kent, to him lot ■

the same cannot now be obtained, and
praying that a copy if said note which i*
annexed to hi* said petition may be estab
lished in lieu of the said original, in terms
of the net of the General Assembly and the
rules of court, in such cases made, provid
ed, and established; —and (he said peti
tion being supported by affidavit; it is or
dered, that u copy be established in
heu of th original so lost or mislaid, a
greeably to the prayer of the petitioner
unless sufficient cause be shewn to the
•contrary, on or before the first day of the

UPON the petition of Albert Godhee,
stating that he wss possessed of a
certain promissory note given by Nathan
iel Cannon—bearing date the Bth cf A
pril, in the year 1819, for the sum of three
hundred sml sixteen dollars, which note is
now lost or mislaid that it cannot he
found, a copy- of which is how on file in
the clerks omce of this court, as near a*
the said petitioner can recollect, together
with an affidavit, stating the loss of the or
iginal. It is ordered t* at a copy of said
note be established in lieu of the original,
unless cause be shewn to the contrary at
the next term of this court. And it is fur
ther ordered that a copy of this rule be
published in oqe of the public gazettes of
this state, once a month for six months
proceeding the time of shewing cause
thereon.
