Collection will be complete.
The importance of this work, and the mag
nitude ol the undertaking, it is expected v. m.
insure it some attention, not only from the ] -
lesjion, hut also from those who feel thetusc!-. i ■>
interested in the literature of our country, it
is the first and only attempt that has been m • .1
to rescue from oblivion important and interest
iog criminal trials that have taken place in tbc
United States, and which independent of thu. -
immediate usefulness to the lawyer, arc, 'the
most interesting species of history, and inculcate
some of the purest lessons of morality—‘•they
exhibit human nature in all Us variety of form
:uul rolour.
Ol the usefulness of this work it is not ne
cessary to speak. It is designed for those*, hi
are able and willing to judge (or themselves-
It cannot hut be matter of regret, as well as of
astonishment, that, a collection of these trial's
has nut boon made before, llow is the student,
and even the lawyer, to become acquainted wi h
the criminal jurisprudence of his country. Out
shelves arc loaded it is true, with reports ct
judicial proceedings; they are so numerous
to be considered burdensome; but from Du
reports criminal trials and decisions arc almn-a
entirely excluded. They do not come station
the notice of the reporter ; they take place n
the Circuit Court of the United Slates; in
Oyer and Terminer, or Session of the different
Statu*. “ They make a noise in their day Ibid
are forgotten.”
The importance of an accurate know! edg.
criminal law has never born denied, but the d'.(
ficuUy ol obtaining it has often been acknow
ledged in Dio United States. The humiliate;
tact that we are almost entirely indebted to
English rases and decisions on this branch of the
law cannot he doubled. The evils which limn
result (rom such a system arc incalculable mid
inevitable. The Genius ofour free iiwlit 11 linn ,
of government, do not com pool with many of
the tyrannical and arbitrary principles tin 1
forms el 1 lie criminal code of Great Britain, 1

criminal jurisprudence ol a republic must of
course vary essentially from that of a country
governed on moriarchi.il principles, and we will
venture to affirm, that no Kingdom on earth
presents to (he American jurist a chain ofpn
cedents calculated to produce an enlarged, <ll •
net, and enlightened view ol the criminal code
ol the United State. For this we arc to look to 1
our own courts and adjudications. It is to sij p-,
ply this important chasm in the jurisprudence
ol our country that these reports have been
undertaken. (Seo preface to vol. 2d.)
In these trials, the life, liberty, or reputation
ol some person is always at stake, and they draw
forth the fire of the brightest genius of the age,
hind the first talents of the place.—Bhall their
noble exertions he lost in the imperfect and
evanescent recollection of an audience; live
jnit fora day in a Gazetteer; or sustain an ephe
meral existence in a pamphlets They shall
not, il there he industry, and perseverance in
the editor and publishers, and liberality among
their patrons.
Air. Salmons remarks, in his preface to (hat
tnpenduous collection of state trials ; the most
entertaining and perhaps the most useful book
in the English language, accord with the views
ol the editor of tliil work, anil m y he applied tu
tho present undertaking: “ We shall detain
the reader no longer than to observe, that this
collection will not only be useful to the learned
in the law, and those whose misfortune il may
tie to fall under a criminal .prosecution, but in
many instances, it corrects as well as illustrates
our English history ; and there is scarce a con
troverted point in divinity or politics but the
reader will find lias been fully debated here by
the greatest men our nation has bred.”
The Ist and 2d vols. of this work have al
ready been published. The first volume is prin
cipally filled with cases collected in the court*
of this city ; the 2d vol. contains a treatise on
the criminal laws of the United States, in the
form of a preface. The treatise embraces a
more extensive view ol the criminal laws of the
United Slates than has been published. And
i as far as the editor and publishers have been
1 able to learn, (his work as it has progressed, ha
met with the decided approbation of the geu les
men of the bar. If the tame liberality is con
tinued which lias been offered and received, the
most favorable result to this undertaking is
