Uncle of the undertaking, it is expected will
iusnre it some attention, not only from the pro
fession, ■ ut also from those who feel themselves
interested in the literature of our country. It
is the first and only a'tempt that has been made
to rescue from oblivion important and interest
i"g crimiual trials that have taken place iu the
United States, and which independent of 'heir
immediate usefulness to the lawyer, arc, the
most interesting species of history, ami inculcate
some of (he purest lessons of morality—“they
exhibit human nature in all ifs variety of forms
and colour.” *■
Os the usefulness of this work it is not ne
cessary to speak. It is designed for those who
are able and willing tojudge for themselves,—
It cannot but lie matter ol regr't, as well as of
astonishment, that a collection of these trials
has nut been made before. Mow is (he student,
and even the lawyer, to become acquainted witli
the criminal jurisprudence of his country. Our
are loaded it is true, wilh reports ol
judicial proceedjngs ; they are so numerous as
to be considered burdensome; hut from those
reports criminal trials ami decisions are almost
entirely excluded. They do not come within
the notice of the reporter; they take place in
the Circuit Court of the United States; in the
Oyer and Terminer, or Session of the different
States. “ They make a noise in their day and
are forgotten.”
The importance of an accurate knowledge of
■ riminnl law has never been denied, but the dif
ficulty of obtaining it has often been acknow
ledged in the United States. 1 lie humiliating
tad that we are almost entirely indebted to
English cases and dec-sinus on this branch of the
law cannot be doubted. The evils which mus
result Irom such a system are in.alculable and
inevitable. The Genius of our free institutions
of government, do not comport with many o)
the tyrannical and arbitrary principles and
firms of (he criminal code of Great Britain, yet
we arc obliged to have recourse to it for rules
of construction to explain our own ! The
ci iminal jurisprudence of a republic must ol
course vary essentially from that .of ar untry
governed on mouarchial principles, and wo will
venture to affirm, that no Kingdom on earth
presents to the Aineviran jurist a chain of pre
cedents calculated to produce an enlarged, cor
rect, and enlightened view ol (lie criminal code
ofthe United State. For this we arc to look to
our own courts and adjudications. It is to sup
ply this importaul chasm iu the jurisprudence
of our country (hat these reports have been
undertaken. (See preface to vol. id.)
In these trials, the life, liberty, or reputation
of some person is alwaysat stake, and they draw
forth the fire ol the brightest genius of the age,
and the lirsl talents of the place.—Shall their
noble exertions be lost in the imperfect and
evanescent recollection of an audience; live
but foraday m a Gazelp er; or sustain an ephe
ineral existence in a pamphlet? They shall
not, if there be industry and perseverance in
(he editor and publishers, and liberality among
their patrons.
Mr. Salmons remarks, in his preface to that
stupenduous collection of state trials ; list moat
entertaining and perhaps the most
in the English language, accord with the views
ofthe editor of this work, and m y be applied to
the present undertaking: “We shall detair
the reader no longer than to observe, that this
collection will not only bo useliil to the learned
in the law, and those whose misfortune it may
lie to fall under a criminal prosecution, but in
many instances, it corrects as well as illustrate;
our Euglish history ; and there is scarce a con
troverted point iu divinity or politics'but th
reader will find lias been fully debated here by
tiie greatest men our nation has bred.”
The Isl and 2d vols. of this work have al
ready hecnpubli-hed. The first volume i? priu
civ-ally filled wi ll cases collected in tiie cour'
of this city ; the 2d vol. contains a treatise on
the criminal laws of the United irt-.trs, m lie
form of a preface. The treatise embraces a
more extensive view ol the criminal lawso. the
United Stales than lias been published. And
as far as the editor and publishers have been
able to learn, this work as it has progressed, ha
met with the decided approbation ofthe gm 1c
men of the bar. If the same liberality is con
tinned wliicii has been oficred and received, tin
most favorable result to this undertaking is
anticipated.
