AN ACT
Fftahlijhing circuit courts, and abridging '
the jur j'dithon of the difirid conrts of
the dijirids of Kentucky, tennejfee and
Ohio,
BE it euaded by the Senate and lloufe of
ReJ>refentati<ves of the United States
of America, in Covgnfs assembled. That
so much of any aft or aits of Congress, as
veils in the diftrift courts of the United
Sta tes, in the diftrifts of Kentucky, Eafl:
and Weft Tcnncflce, and Ohio, the powers,
authority, and jmifdi&ion of the circuit
courts of the United States, shall be, and
the fame is hereby repealed.
Sec. 2. And be it further enaded, That
for the piupoie of holding therein the cir
cuit courts, to be eftabliflied by this ait j
the (late of Kentucky (ball constitute one
diftrift, the Rate of Tcnnefl’te one diftrift,
and the state of Ohio one dill rift, and the
said diftrifts of Kentucky, Tenneflee, aad
Ohio, (hall conllitute and be denominated
the levenlh circuit. And tlicrc shall lie
holden annually in each diftrift of the said
circuit, two courts, to be called circuit
courts, and to confifl of one juflicc of the
supreme court of the United States, and the
judge of the diftrift where such court shall
be holden. And the fiflions of the said
courts, in the didn't of Kentucky, (ball
be held at Frankfort, and commence on the
firft Monday in May and November, annu
ally ; in the diftrift of Tenneflee, at Knox
ville, and Naflaville, alternately, to com
mence on the firft Monday in June, and
third Monday in Oftober, annually, be
ginning at Nathvillc ; and in the diftrift of
Ohio, at Chilicofhe, to commence on the
firft Monday in January, and September,
annually. And the circuit court of Tennes
see (hall designate at which of the two pla
ces whsrs the said court is hoteby direfted
to be holder}*, the ellice of c;lerk, thereof
dull be liept.
See. 3. And be it further evaded, That
all the authority, powers and jurildiftion,
veiled in the fetcr.il circuit court! of the
United States, or the judges thereof, or
cither of them, Ihall he, and hereby are
veiled in, and (nay be exercifcd by the
fcmal ciicuit courts of the fevcnlh’ circuit*
and the judges thereof: And that all ac
tion.l cattles, pleas, process, ai.d other
pioccedidgs, relative to any cause, civil
of criminal, which (hall he returnable to,
or depending in the several dillrift; courts of
Kentucky, Tcnncflle, and Ohio, afling as
circuit courts, on the fu ll day, of May neat,
Ihall he and hereby yte declared to he rc-
Ipeciivtly transferred, returnable, and con
tinued, to the several circuit courts con
llitutcd by this aft, at the times herein ap-
I pointed for (he feflion of each of the said
courts, and ftiall he beard, tried, and de
termined therein, in the fame manner, and
with the fame effeft, as if no change had
been made hereby in the courts of the said
dill rift. And the said circuit courts of the
fevenih circuit, Ihall be governed by the
said laws and regulations as apply to the
other circuit courts of the United States*
and (hall appoint clerks for the said courts*
refpeftj velj, who Ihall reside, and keep the
records of the said courts, at the places of
holding the courts, whereto they Ihall rc
fpcCtivciy belcr.g, except as herein before
provided, and shall perform the fame duties,
to, be entitled to, and receive the fame
emoluments and fees, refpeftivejy, which
are by law eftablilhcd for the clerks of the
other circuit courts of the United States.
Sec. 4. And be it further evaded, Tibet ‘
the Hate of Tennessee shall be divided into
two diftrifts, for the purpose of holding
dill rift courts in the fame, one to consist of
that part thereof, which by the laws of the
said date, now forms the dillrift of Walh
irgvon and Hamilton, which Ihall be called
the dillrift of East Tenncffec ; and one oth
er to consist of all that part of the state of
Tenr.dfee, which by the laws of the said
state now forms the difttifts of Winchester,
Mere and Robertson, which Ihall be called
the diftrlft of Weft Tenneflee ; and all the
authority, powers and jurifdiftiou, veiled
in the several dillrift: courts of the United
States, and the judges thereof, in those
dill rifts in which circuit courts are now
held, Ihall be retained, and may be exercifcd
by the several dillrift courts of Kentucky,
East and Well Tennessee, and Ohio, and
the several judges thereof. And the fdfions
of the said difttift courts Ihall after the (lift
day of May* next, be as follows: in Ken
tucky, at Frankfurt, two fdfions, to com
mence on the fiill Mondays in June and
December, annually; in East Tennessee,
at Knoxville, two feflions; to commcnee
on the third Monday in April, and fecund
Monday in Oftobcr, annually ; and at Nalh.

fourth Mondays in May and November,
annually ; and in Ohio, at Chilicothc, three
fdfions, to commence on the firft Mondays
in February, June and Oftober, annually,
and all aflions, cause?, picas, proccfs, and
other proceedings, relative to any cause,

turned and held continued to the said seve
ral dillrift courts, refpeftively, at the times
herein before appointed for holding the
fame.
Sec. 5. Be it further That the
supreme court of the United States (hall
hereafter consist of a chief justice, and fix
affociatc joftices, any law to (the) contrary
notwithftanding. And for this purpose
there (hall be appointed a sixth associate juf- v
tice, to reside in the feyenth circuit, w hose
duty it (hall be, until he is otherwise allot
ted, to attend the circuit courts of the said
seventh circuit, and the faprease court of
the United States, and who (hall take the
fame oath, and be entitled to the fame salary
as arc required of, and provided for the
other affociatc justices of the United States.
