fIMIE petition of Ebenezer Staines and lsbam Saf-

the' year 1844, John Phillips executed to your peti
tioners s Mortgage Deed to secure a note made
parable by the mid John to your petitioners, da
ted the ninth day of April, 1844, and due the first
of October thereafter, for this sum of five hundred
dollars, and that for and in consideration of mid sum
the aid John bargained, granted and sold to
your petitioners by Mortgage the following prop
erty, to wit: Lot No. 80, m the fourteenth district
of originally Early county and now Decatur, in the
State aforesaid, ana Lot No. 123, in the 31st district
of originally Early now Decatur county, and State
aforesaid, and Four petitioners show that mid sum
of five hundred dollars are doe and unpaid. Where
fore your petitioners prays a Rule Nisi may be
granted, requiring the mid John to pay into
this Court on or before the first day of the next term
of thb Court, the principal and interest of said note
as before mentioned, and all costs that may hare ac
crued thereon at the time of such payment, or in
default thereof the Equity of Redemption of said
John Phillips to said lots of land be forever barred
and foreclosed, and petitioner will ever pray.

consideration five dollars to said Watson then in
hand, paid by the mid Taylor, as well as the better
securing the payment of a promissory note, given
by said Watson to said Taylor, or bearer, for the
payment of the sum. of twenty-two hundred and for
ty dollars, one on or before the first day of January,
eighteen hundred and forty-five, (last past) and
which note was dated the twenty-second day of
July, 1843
Your petitioner further shews, that afterwards to
wit: on the day and year aforesaid, said note and
mortgage were transferred to your petitioner for a
valuable coaskferatioo, by said Taylor, and that the
same have never been pud, nor any part thereof to
your petitioner, nor any one else legally authorized
to receive payment.
Wherefore, your petitioner prays a perpetual fore
closure of said mortgage, unless said Jacob Watson
shall, on or before the next term of thb Court, pay
the amount of principal, interest, and cost an said
note and mortgage.
