red to your petitioner. And R appearing that the
coosidnation for which said bood wa* given has
been performed, and that the said George w. Pres
cott did never make title* to aid James Singletan,
or hi* transferees. It I* therefore ordered and ad
judged by the Court, that Owin Wakefield, Adm’r
of mid George W. Prescott, after due and legal
nutice by publication, make a title to mid premises,

not paid the two notes, Grit aforesaid or any part
thereof. Wherefore your petitioner prays a Rule
Nisi may be granted, calling oo said Eieaxer Garret
to pay into the Clerk's Office of this Court the
amoont of principal and interest due on first two said
notes on cr before the first day of the next Term of
Court, or shew cause in default of payment why
said Mortgage should not be foreclosed, end the
Equity of Redemption therein contained lie forever
barred, and that service of the Rule Nisi be perfected
by publication accordion to the statute in suev case*
made, and provided said Eieaxer Garret residing out
of aaid State of Georgia.

of October thereafter, for the sum of five hundred
dollars, and that for and in consideration of said sum
the said John bargained, granted and sold to
