It was lhat of Park vs., llamiltou. The history oC thisxasc seems to be as follows : In the year 186J, while the Confederate force* still held possession o.f Memphis, the defendent, Mr. TholbaaA, Hamilton, .Was appointed by tho Confed erate Govcrnoient,.ap .agent to seize certain -sugar and cotton, the property of merchants whom ifcwaa believed were purchasing and holding such commo dities on specuUtion^ iu, view of tlie probable sur render of Memphis to the Federal forces, andagaimd tho laws of the Confederate congress, aud the de clared policy jof tbaC Government; whose ofiiccrs wero instructed tfc*pTWVC»« rffe Urfrlne aeCufntll.Mion of z^Mcles of. prime commercial value at points ns seriously threatened as Memphis then* was. In obedience to instructions then given him, Mr. Ham ilton seised a number of hogsheads >•? sugaW, the property of Dr. A. : J. Park, valued a* $7A.000, and turned it oterco the Confederate Slates receiver, or quartermaster or with other evgacs »: that time t**' ceived, asni it South by railroad. No vonclrers were, given, but a memorandum was made r«t thq time of the value, and number of barrels and hogsheads, and in some cases, we believei copies of such .-were furnished the owners. -Dr. Park' now brings’suit afainst Mr. Hamilton to* recover the value of the propertyscized. ‘ - I » i« , The ease was given fo tlie-Jury on the 24th ult.— The question being asked whether HnmiHou ought fo be held responsible for sugars sold to defray the expenses of transportation. Judge Triggs replied the jury-had no right to inquire for what it Is soM, as the defendant hail no rightto feelWt for any pur pose. On ths -2Htb ultimo the jury came into the court and announced that they were unable to agree upon a verdict, and were accordingly discharged, and tbO'Case goes over to.tbenext term of the court. This is a very-important ease. If it shall decide that the action of Mr. Hamilton, while acting as an agent and under orders ofthe Confederate Govern^" 'meat, or its representative, in the seizure of private property, renders the seizure liable for the value,of' the goods so seized, thcif doubtless many who have lost property will bring suits to-recover the value of property thustakpn by tbe Confederate authorities, if a decision favorable tO'Dr. Park shall be given, then many millions of dollars may be expected to change hands by the action of -oourt?. in fixing the liability of Confederate-agents for all the property they have soixed...
